ill find out for sure tomorrow what they get because i know they dont get the 122 in with their pension credit. Mind you, i dont think they know what they get because ive asked them before if they get pension credit and they said they didnt know!

How can you know that they don't get £122 if they don't know. You need to check this out properly with DWP and have a benefits check with ageuk, CAB or someone who properly understands the application of premiums and pension credits. They may not actually receive the money as it is a premium that is offset against their actual income. However it may passport them to full council tax and rent. They could stand to lose hundreds each week depending on their actual income and pension credit top up.

Do you both provide 5 hours of care each, and every day..10 hours in total a day..Your hours don't add up to 35 they total 22 mon to fri..so you would have to be putting in 13 over the weekend and thats nearly all day sat and sun? Your SIL gets there at 2.30 each day and is either staying until 7.30 each day then going home to her own family or putting in a few hours during the week and spending most of her hours there at the weekend...so that would mean you are both there all day both sat and sun! 70 hours of care a week is alot of care.
  • This link http://www.entitledto.co.uk/help/severedisabilitypremium.aspx shows that they would be getting SDP at the moment and would lose it if you claimed carers allowance. It is already being reduced because one person is claiming carers.

You need a better off calculation done to check the effects on their income of the carers allowance claims.

Just to clarify the severe disability premium is only reduced if someone is paid carers allowance, in this case the father in law is not actually paid, but the premium continues to be awarded. In truth they could both claim CA for looking after each other, and so long as both of their pensions were above the CA rate then they could have two carers premiums and the couple rate of SDP as neither would actually be in receipt of CA.

Caring takes more forms than physically doing something for the other person. :)

And they could then pay their daughters (or someone else) for the work they do for them.

:):Hi all, thanks for all the replies. Just an update...
They do not get severe disablement premium (£122) as the pensions place was not aware of my FIL also being in receipt of AA. This has been sorted out today as they have called pensions and informed them today and are set to get quite a nice bit of back dated money. Weve been to welfare rights armed with a breakdown of their pension credit-£57 of it is guaranteed so when they take the £34 off (carers premium) there will still be approx £23 pension guarantee left so they will still qualify for full CT benefit and full HB too

they are both fully aware that if we claim CA for them both that they will lose the 122 again but they arent fussed, they said theyve never had it so will not miss it plus they need the help. With regards to what someone put about 70 hrs care being alot-yes it is i agree but were not just helping them with their needs, theyve got 2 dependent children livinv with them too. So thats 4 dinners to make, 4 lots of ironing, extra washinv etc and with the holidays coming up they will defo need the help! These kids should be with their Dad (my BIL) as they are his from his first marriage but he cant be arsed with them if the truth be known, their mothers got issues with the demon drink and they cant stand their step mum. Yes its not a great situation especially with the inlaws being poorly but at least they arent in care and we actually care enough about them to look after them aswell as my inlaws.

^^ Hopefully they are claiming the child benefit and child tax credits for these children.

The kids are 18 and 14 so i can't imagine any help will be needed in the holidays...at their age they should be helping around the house anyway...they can both do some cooking, cleaning and stick the washing in the machine and pop to the shops when needed.

you cant count time spent doing things for the kids!
the CA would be for the parents care, not cooking, cleaning and washimng for 2 almost adults!
