    My fiance is about to issue a Small Claims against a firm in Liverpool, some few hundred miles from us.

    Yes it is. It's one of the strongest weapons the private individual has if suing a company, as few companies will consider it worth sending someone to the other end of the country to defend a small claim.

    Northampton is simply the national clearing centre for Money Claims Online. You will get the opportunity to have it transferred to the court of your choosing. Make sure it's not Bournemouth!

    Someone did beat Devere in Court re a residents' car park where they had a right to park. And her defence is there as well in post #29, plus some images to view.

    I wonder if it was the same car park? Either way, you could cite their case. Send them a pm on CAG, why not, maybe they will see it if they get email alerts to private messages?! You'd have to join CAG forum which I would not normally recommend as IMHO their advice is hit and miss on parking tickets. But you could join in order to view their images - and then send a pm perhaps unless that annoying forum stops people forum sending private messages until they've made some posts. If so, make some posts but be warned not to add any links to any other forum such as here, or CAG will come down on you like a ton of bricks.

    thanks, no its a different car park. I guess the only difference is that he actually had a permit. I was never given one, I have looked through my lease and there is no mention of parking or a lease. it is a rented property. Will send the person a pm. Cheers

    It would help you to be prepared to meet the old guy in court and at least you won't be surprised by the hand delivered replies either! I would ask the CAG poster for their claim number and Judge's name (and confirm if it was Bournemouth court) so you can cite it in your own evidence.

    Devere has form when it comes to stating he has sent letters when he has not, it is one of his tricks of the trade to put his targets under more pressure.


    If it gets to court he will have copies of the letters but no proof of posting. If it goes to Court send me a PM and I'll look for some of the threads where others have not received letters.


    It wouldn't surprise me if he is hand delivering either, how far are you from Parkstone Station ?


    Apart from the legal arguments your other weapon if it gets to court is the threat of exposure of the man behind Devere. By all accounts he is paranoid about being photographed and identified.


    If I was in court with this character I'd ask him to prove his identity before the court and prove his relationship with Devere Parking Services Ltd. It is the time when he is at maximum risk of exposure as he is out in the open and not hiding behind mail boxes and telephones. I would be looking for the support of one or two friends with mobile phone cameras at the ready when it came to court.

    If you can't read about any risk of a charge, when arriving by car and deciding to park, there is no contract.
