so let me get this right, your bird is now still living with room mates she doesnt like, has a legal contract to pay £2300 back for no reason and thru emotional blackmail has you in debt for £1150, great, sounds like a win for me.
in a couple of years you both will realise you have been exploited but hey i know guys who have blown a lot more than that on ther women, granted none are still with the but you live, you learn.0 -
This is unbelievable, you and your girlfriend should not pay a penny to that greedy landlord move out !!!!!!!!0

I have read a few threads on this site before, but never ever seen anything like this and subsequently it has motivated me to join.
When reading your circumstances it is difficult not to feel outraged, both with the landlords (LL) behaviour and by the acceptance of the landlords behaviour. But it is important to stick to the facts and think about what actions you can take.
1. It is not in the contract for you to pay any additional rent as their is nothing in the contract. This is very important, the LL if they took you to court would find it difficult to make you pay.
2. While a claim could be made through the small claims court, (the cost is only £80 to start a claim), you would then have the chance to state your case, the LL would look a fool with their current contract asking for backdated rent for guests.
3. Becuase your GF has now signed some sort of agreement, you really should take this up with a lawyer and see if the LL has now strengthen their case.
4. Your GF signed the contract, YOU DID NOT, how can she sign a document that makes you liable for cost, that is ridiculous. If it was the case, can I sign a contract making you liable for paying my rent. This is plainly nonsense.
5. If your GF signed a legaly binding* document (* check with a lawyer) and if it is binding, then I imagine she could be liable.
6. Did you at any time state to the LL or your GF that you would pay rent and if so how much? If you did, you may find that they may use what you said to support their case, although it is really quite weak. You do not want to help them make a case against you. Stop talking about it with them and do not offer to pay any money.
7. If you do talk about it, either record the conversation and document what was said. Or perhaps get them to document their claim in an email or letter to you. the more infomation and paper trial that you build up that disproves their case and allows you to state yours the better. Otherwise it simply comes down to a case of your version of events against theirs. To be honest the LL was v. clever getting your GF to sign something.
8. While the threat of a CCJ can be daunting, read about it and find out how you can defend yourself.
9. speak to a lawyer, or speak to Shelter or perhaps the Citizens advice bureau.
10. Think about how you can get back at the LL. Do they ahve a deposit? if you move out, and you dont get it back take out a CCJ on them, its suprising easy and I have taken out numerous claims on people and always got my money with interest and costs.
11. Is the LL declaring their income on their tax return? Dont use this as a threat, but shouldnt your deposit be held in a Tenency Deposit Scheme, if so ask if it is. You may not be challenging them about whether they are paying tax, but the request for the Tenance Deposit Scheme will make them aware that you know your rights and the LL will know that the Inland Revenue monitor the deposit scheme and that make make your landlord uneasy.
It is importnat to try and distance yourself from teh emotional element of the LLs bad behaviour and focus on teh facts. DO NOT SAY ANYTHING ELSE TO THE LL, AND DO NOT AGREE TO PAY FOR WHAT YOUR GF SIGNED.
It sounds as if your GF has been bullied into signing this document. To be honest it sounds as if your GF is more afraid of the LL and will not stand by you. Personally I find that unbelievable, even given your GFs situation. She really needs to stand by you. I know its a cliche, but together you are stronger.0 -
I've just read this thread, and right from the beginning it sounded like the girlfriend is dodgy I'm afraid. Forgive me if I'm wrong, but have you ever spoken to the landlord or been approached by the landlord about this personally? Has all information come through from your gf?
Why would she sign a document saying she owed all that money after reading all the comments on here? Nobody but the stupidest fool would sign a document saying they owed money when they knew they legally didn't have to, and how convenient that the LL didn't want you there...
Personally, I think she is tapping you for the money (how did she want you to pay for your share?) and there is no legal document signed.
Lastly, even if her flatmates are peed off with you being there, is it really going to make them any better off by you paying a partial rent to the LL? If it was going to lower their bills fine, but it sounds like anything you pay will go straight into LL's pocket. That's not going to make anyone happier except LL (assuming the ll really has anything to do with this).
Sorry if Ive got it all wrong.0 -
Hi everyone,
At last, your long-awaited update...
The landlord and my girlfriend met up last night, had a loud and aggressive discussion, the landlord refused to back down and continued to ask for £2,300. Eventually, and for reasons that still don't make perfect sense to me, my girlfriend decided to sign a document to say that she'll pay that much. She's also asking for half from me.
I'm shocked that you have given in to that greedy BAS****
I'm not going to comment on my thoughts as I don't think I need to. I don't know if I need to have anyone else's comments on this issue, as I'm not entirely sure of what the point will be.
The point is you are BOTH so weak, and have been taken ! This LL now believes it can screw other people and get away with it. ( Although you prob; brought some of the grief on yourself )
As the document has been signed, mainly because my girlfriend didn't want to be evicted with very short notice and run the risk of being homeless, that's what we'll have to pay and that's that.
A long ago, I was once a tenant, and TBH I would have slept in the park first.
Thanks everyone for your help - at least you now know the outcome...
No ! Thank You, I'm just popping off to change my USER NAME0 -
Is coercion a mitigating factor in contract law? If so, then it's altogether possible that the document signed by the girlfriend in this situation is entirely non-binding because the landlord has evidently been extremely aggressive about forcing the girlfriend to sign this agreement. I'd personally see a lawyer and ask him/her if such a document is binding, and if the answer is "no" I would walk away from that place and never go back, instead getting the girlfriend to visit me.
Ridiculous situation, and I hope you are NOT going to pay this stupid amount without seeking legal advice first!I am a Chartered Financial Planner

Absolutely agree with most sentiments on this thread.
As a Landlady I would have no problem letting out a property to an individual only to have them populate it with anything up to 50 people on a temporary basis, sharing but not contributing towards the facilities paid for by my tennants in legal occupation.
