PCN issued from IPC member and Notice to owner from BPA member???

Hi again,
I am just trying to refine my complaint to IPC now. I was just wondering how I can complain to IPC if the Notice to Owner was not POFA compliant as this letter was issued by PCS (member of BPA). If I do so, isn't it likely to receive a reply that PCS is not a member of IPC, thus they cannot do anything about it? And what if UKPS claims that they have sent me their Notice to Owner letter in time months ago, but I just didn't received it and then they turned to PCS which sent me their Notice to Owner.
Is ignoring a possibility at that point or I need to complain to IPC in order to avoid paying the ticket in future?0 -
the PPC is a member of the IPC and the one who issued the pcn so its not your problem if any debt recovery firm they use is or isnt licensed or by whom
the PPC (UKPS) are the ones issuing and pursuing the debt, so they should adhere to the CoP of the appropriate AOS
if you have been denied your correct procedures, then you complain, but as your PPC is a member of the IPC, its the IPC you send your complaint to
by all means copy in the debt collector if you want to, that is your choice
ditto with the DVLA
ditto with your MP
ditto with Trading Standards
ditto with anyone else
but your prime focus on this is the IPC, and the landowner0 -
I drafted this one. Is this one OK, or i need to add anything or be more specific why NTO is not POFA compliant?
I am writing this letter to inform you about a serious breach of your Code of Practice, which resulted in significant nuisance for myself. As the registered keeper of ****** with plate number ****** I have received on 12.06.2014 a parking invoice (named Notice to Owner) which of course, I declined to pay. This invoice was regarding a Parking Charge that has been issued on 22.03.2014. Enclosed I am sending copies of my appeal and proof of postage.
On 26.07.2014 I have received another letter from one of your valuable and honored members UKPC (North West) Ltd, dated 26.06.2014 and mailed almost a month later on 22.07.2014 (enclosed I am sending a copy of the envelope). In this letter UKPC (North West) Ltd states that I was out of 28 day time period to appeal my parking charge notice. As this is just not true AND the Notice to Owner is not POFA compliant I demand you to contact this member of your organization and advise him to conduct the case according to the Code of Practice your organization.0 -
You've put UKPC. Yours is UKPS0

Yes, that is my mistake. I will put the correct name. Thanks.0

Hello,
In response to my last letter I have received reply from IPC that they admit the PCN was not OK and they have cancelled it and will train their staff in order not to repeat situations like this. I would like to thank everyone who helped me in this journey and advise present and future violators of parking rules to fight for their right:).
P.S. Do I need to write to the DRP (debt collectors) to inform them about the outcome of my appeal or they will be informed somehow and will not bother me?0 -
Good news. Can you post this decision on the IAS decisions thread. Linked to in Crabman's sticky at the top of the forum.
Just ignore DRP. In fact keep hoping that they send you letters after Oct 1st when there is a law change and you will be able to make a claim against them much more easily than now!Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Here is the decision from IPC:
[Removed]
IPC allows my appeal (initially disallowed) and informs that charge has been cancelled.
Thanks to everyone who helped me one more time.0 -
the Operator has ensured that they are conducting further training for their appeals team.......
In what? How to correctly read the date of an appeal and work out whether or not it's within 21 days of the date of the initial appeal rejection? How difficult is this stuff ......? :rotfl:
Well done OP by the way, good outcome. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
