parking charge notice at hospital

Thanks , I have now got one very irate nephew who is going to give them my name as he feels this is all hanging on his address etc etc . He wants nothing to do with it so may just have to give in although every bone in my body is against it . Thanks for the help
He really thinks this is a fine? Thinks it will affect his credit rating? Wrong - and he'd be sooo much better off in the future if he knows about private parking tickets and how to win the appeal. We win every single appeal as well, oh dear, by naming you as driver you might have to put up with debt collector letters for the best part of a year thanks to young nephew who thinks he knows best.
OK, so you'll have to try the other tack which would be for you (not nephew) to send Vinci a copy of the appeal they ignored and ask 'where is my POPLA code?' And to send an email complaint to the BPA saying Vinci have ignored your appeal and have sent a follow up letter instead. Admittedly they are not yet past 35 days after you appealed so they can still reply and send you a POPLA code.

Thanks very much , will talk again with nephew ! But think may just have to follow the where's my POPLA code.
If he does name me and i get debt collectors letters can they follow through , ignored PCN in Aldis before rules changed and only received 2 letters from parking company , that was over 18 months ago . Thanks0 -
Ah Redx you are right, thanks for that I was told to write and yes although I love a bit of letter writing I think because I only discovered the forum on here a day or two before my 14 days was up I didn't think a letter would get to them in time . Need to act a lot quicker in future thanks0

of course "they" can follow through, that is the reason we ask people to follow our help to the letter. in these cases its the landowner or vinci in this case that could issue the MCOL after an LBC , so it could go to small claims court
BUT as explained in the newbies thread, the debt collectors cannot do anything at all, despite their threats and red letters
as for the aldi saga above, you are one quarter of the way through the 6 year window for court proceedings to ensue , as its 6 years to bring a claim to the small claims court (MCOL). CEL are currently doing this with old cases as well as new ones
Parking Eye and others do take people to court over these matters so it probably depends who that PPC was but never say never, even companies that havent gone to court in the past may do so in the future
I agree again with CM, write (posted letter this time with free certificate of posting) using the template letter and ask where your popla code is etc, also complaining to the BPA about no popla code
the point here is to get a popla code issued to one of you , ideally your relative
and as I have already mentioned and yet you appear to have ignored, the best cancellation for closure is one by the landowner, that would make all of this go away and be unnecessary
this is because the landowner is the ultimate person that could issue court proceedings, the PPC cannot win at court without the landowners agreement or collusion0 -
Yep go for the 'where's my POPLA code?' option then to keep nephew out of it now. Debt collectors still have no powers, nothing has changed that much although some PPCs have started suing people, that's why you need to stamp it out at POPLA!Thanks very much , will talk again with nephew ! Hi Again , wrote again to facilities at the hospital , new person taken over they have looked into my case and cancelled told company to cancel the charge . I know I have read on here that it is not always the case , how do I go about finding if this has happened0
-
You should hear from the PPC to say it has been cancelled.
Have you got evidence (email/letter) from hospital to say it has been cancelled? If so make sure you keep it. If not make sure you get it.
The. If PPC come back to you with a rejection and a POPLA code, then you tell POPLA that it has been cancelled (along with all the other things you would normally appeal on)
Let us know what you hear next in case we need to point you in the right direction.
But a provisional piece of good news. Complaining to landowner is always best way to go.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Good result, as far as it goes.
Firstly, did you get this in writing from Facilities? If not email them and thank them for their intervention and cancellation of the charge and the fact that they will be instructing the PPC to cancel. Just politely ask if they could confirm your understanding of this. You then have written proof from the principal to the contract.
But you will only know if the charge has been cancelled when you get confirmation of that in writing from the PPC. Remember, it is their charge, not the hospital's charge.
I wouldn't go chasing the PPC, but wait to see what happens over the next few weeks. I suspect that once they've been told by the hospital they will cancel (but may not confirm it to you) - but nothing is guaranteed in PPC world.
So getting the hospital's confirmation is important - and you need to hold on to this for up to six years (as a 'debt' can be pursued through the Small Claims Court any time up to six years after the event). I don't think it will come to this, but take nothing for granted!

Thanks, I have it on a work e mail , it's not going anywhere. And thanks for letting me know about the 6 years, I guess after that amount of time I will have forgotten where I filed it !. Yes will wait for company to advise of cancellation and will e mail back to facilities asking for confirmation again . Thanks again.0
