Of course you can do chargeback against Paypal and you should do so if your card has been fraudulently used funding a Paypal account. In your case it hasn't.

It say's you can. For a item not as described...

When a customer files a chargeback with their credit card issuer, it means that they’re disputing a charge and asking the card issuer for a refund.

A customer might file a chargeback because they:
    • Didn’t receive their item.
    • Received a damaged or defective item.
    • Don’t recognize a credit card charge.
    • Were charged more than once for something.
    • Didn’t authorize a payment.

The're listing reasons why buyers might do a chargeback, it's not saying anything about what the consequences of doing so will be. In any case, it doesn't matter since there is a straightforward way of dealing with your issue through Ebay.

Yes you can, you can charge back via your card issuer and they'll take the funds from the buyer. You still need proof into WHY are you doing a charge back however, or the charge back may fail, or you may get a negative Paypal balance.

Far easier to just say to Ebay "Item not as described, request full refund from seller". As a buyer on Ebay, you have the upper hand.

Well the issue with sending it back... what is if seller say's I have damaged the item?? I won't get a refund?

Apparently going to get a pre paid label...but they aren't fully tracked are they? Does it track it from sending it at the post office to saying it's out for delivery (should be for parcelforce hopefully)? The item is going to a different country

And what if this item get's lost?

It easy to say, send it back. But I don't feel very covered by this!

As I said, you need to ask for help in the Ebay forum if you are unsure how to proceed. There are good answers to all your questions. If you return an item as "Significantly not as Described" you will get a full refund, however you need to make sure you follow the correct procedure.

Your rights as a buyer are far more than the rights as a seller. That's why I hate selling stuff on ebay, as the buyer has so many rights that sellers can (and do) get screwed.

If the seller gives you instructions on how to send it back and you follow those, it doesn't matter if the parcel gets lost. You'll still get a refund. It's best if you can include a "Proof of posting" or tracking number in your e-bay correspondence, but it's not 100% required.
