Ebay, Paypal & Chargeback

Hi,

Today I received a item from ebay. It was marked as 'new with box'

But the actual item, was not new (has scuff marks, scratches etc) They have clearly been worn, and I was also not sent the original box. (the item was over £200)

The seller has obviously fobbed me off. Only worn around the shop apparently.

Anyway, I do not trust them. And I've never done a charge-back before.

So as I obviously paid through paypal, and straight from my credit card. Would my credit card company take a charge-back on a item not as described? I have tried reading it up, but there's quite a bit of conflicting information.

Thanks

Well I'm thinking of doing that 1st.

But I just want to know, if I have the option to do a charge-back on a item not as described? I have tried reading it up, but there's quite a bit of conflicting information.

The seller keeps lying, so I find I'm just going to have more problems. So need to know what other options I have.

There's no need to even think about charging anything back, there are plenty of buyer protections offered by Ebay and if the item you received is not as described you will get a refund for sure if you follow the correct procedures. I suggest you ask in the Ebay forum (in here) for help if you are unsure how to proceed.

You can now do so via eBay, or alternatively via PayPal to ask them to settle a dispute if you cannot reach one with the buyer.

It's certainly best to keep any records of conversations with the seller, especially if the seller is being malicious. PayPal will take 10 days from opening dispute to settle.
  • I guess I'll have to ask my credit card provider then.

It's a-lot of money. And I just need to know if I can do a charge-back or not. I sent a message to the seller with pictures (even though they know its not brand new)

Just claimed they was worn the in shop only. When the soles are black and full of stone marks and scuffs etc

You should only do this as a last resort, PayPal usually bend over back for buyers. Just open a dispute with PayPal - should be sorted.

Are you reading the anwers you are getting? You don't need to ask your creditcard provider anything, just open a claim with Ebay (not Paypal) and you will get a full refund, guaranteed.

Your CC has no connection with the seller whatsoever. You did not use your card to buy a pair of shoes but to send money to paypal, which was obviously done without problems. It is paypal who is linked to the seller, not your CC.

As others have said, complain to eBay "Item not as described". A typical paypal claim would be about non-delivery.

You can't claim for the same thing twice. ;)

Why? You've already been told here to use ebay buyer protection.

But by all means ask your credit card company and they will probably suggest the same.
