    If you get it set aside then that will cost £155 to the court and then if you defend and still lose then that would typically be £180 to ParkingEye.

    Conversely, if you defend and win then you can ask for your costs.

    Although working abroad , wheni came back last week I went through all mail and not one letter from the courts. I call them up to find out about this CCj and tye claim a letter was sent in march and then in April. Nothing had come.

    And the what comes through the post this morning. A letter from
    The courts dates 0904!!! !!!!!!

    Can you get your postman to confirm that he delivered that letter today? If you contact the PO sorting office quickly you may be able to find out why it was delayed (had they lost it with a batch of mail behind a cupboard or something?!) and whether the postman or PO can give you something in writing to show the Court that this was never delivered before today. That (along with the fact you would need to show grounds to defend and reasonable prospects of success) would be a reason for a court to allow a set aside. But like I said it costs you £155 up front to rewind this back to a defendable stage.

    If you are often abroad then this may not be ideal as you would then have to proactively act to defend the case and respond in time to each part of the court process and then attend a hearing if one takes place in the end. Setting it aside just gets it back to the first court papers stage.

    Really? Is it the same claim number or - you don't think you had two cases with PE? Yet the claim is dated April? I think you should start your own thread about this now.

  • It was the franking date yes, so it means that is when it was sent. Its all very bizzare, i jsut want rid of the bloody thing.

    Oh I see - the court has sent you a copy last week then (obviously) because you phoned them, that's all. So you can now get it set aside as we explained by telling the court you never received the letters at all at the time and that you have good prospects of successfully defending the case (if you have time to read our threads & defend this and attend a hearing or two). Set aside costs £155 though - or you could copy what AaarDee did even though I wouldn't, as he PAID ParkingEye then got them to mark the CCJ as satisfied (does not remove it).

    Not sure why this thread keeps getting bumped. No-one wants to read about people paying PE.
