I'm not sure about the legal side but I would have to agree with those sayign the neighbour has no moral obligation to trim his tree. It has nothing to do with who has lived there longer and it is certainly not antisocial of the neighbour to wish to preserve his tree.
Oh of course it's antisocial.
If the next door neighbour goes ahead and sticks a 30ft mast up in their garden, it's pretty antisocial...and there are laws to prevent it.
If they stick a 30ft wall up on the boundary it's pretty antisocial...and there are laws to prevent it.
I don't really see what difference it being a tree makes. It's still pretty antisocial, so I don't really understand why there aren't laws to prevent it.
If you're going to live with neighbours, you should be considerate and plant trees that only grow to a reasonable height, I don't think that's rocket science, really.0 -

Yes, I'm sure someone could roll out a list of government approved trees and set up a Department for Arboricultural Reasonableness, staffed by tree police, all of them M.Hort qualified. They could cruise around in 4x4s, ready to spot errant topiary and slap a suitable fine on the owner.

Offer him a load of dosh. Even if you don't have it.
His reaction will be the key.
Say you said I'll give you £20,000 if you remove it, or cut it back. And he says OK, thanks.
Well the tree is not important anymore.
If he says no thanks. Well it's all over. And he means it!
I think paying money might get your view back..... And it might be worth considering? But I was exaggerating re the 20k, but you get the drift.0 -

Say he accepts the offer (however much) & then the OP turns round and says "sorry I can't actually afford that" do you think that will improve relations?0 -

I've had enough abuse and people passing sound judgement on a case they don't know the specifics off to not give away my address to some of the kind of people that frequent here.
OP I sympathise, you came on here for some advice and some of 'the usual suspects' appear and seem to want to try their best to paint you as some horrible neighbour.
You have done the right thing by asking your neighbour nicely and there is nothing wrong with doing that, indeed most neighbours would have apologised for being unthoughtful and then trimmed the trees.
You are unfortunate in that your neighbour isn't a good 'un.
I know that in your situation I would be looking to turn the trees into ex trees, I am sure with a little thought you can come up with a number of ways to achieve this a couple of years down the line.0 -

I'm now pretty sure they are lelandai but a yellow version. They are planted within 10m of my garage which isn't connected to my house but is highlighted on my deeds.0 -

'Criminal'? Only if you get caught
On a more serious note...

Hamy friend that's built like a truck said one yank from him and he could snap it in half on a windy night...
Thanks for the link0 -
I'm confused. Is the hedge in question evergreen? Are the trees part of the hedge? Have you done the calculation about distance, slope and length of hedge that is necessary to determine whether a hedge is 'high' or not? Do you know that merely obstructing a view does not constitute nuisance? Is there some other factor - obstruction of light, perhaps - to be taken into consideration?0
