Hello Everyone,

If you know anything about Parking Regulations please read.

I am a Uni student and my Uni has issued me with THREE parking fines (3rd 4th and 5th of June) for parking at the Uni campus for three days during the holidays.

However the Uni parking regulations clearly states that:
"The Regulations apply during term time only (23rd September 2013 to 13th December 2013 then 13th January 2014 to 4th April 2014, then 6th May 2014 to 23rd May 2014) on the King Alfred College and West Downs Campus from 0800 to 1600 hrs week days and at all times throughout the calendar year at the Sports Stadium.

I had checked this before I parked at Uni, when I contacted the Uni parking office the lady avoided my argument that the regulations dnt apply after the 23rd of May because the uni had put up a notice on the Uni site stating the everyone needs to get temporary permit even for holidays even despite the fact the regulations clearly state that you dnt need to, its free.


She insists that I have to pay the fines but my argument is that the Uni regulations hasn't changed, nobody is going to look at the uni front page for parking notices, people will just download the parking regulations document and have a look at that.

The bottom line is that the Uni parking regulation states that parking free after the 23rd of May - September but the Uni parking office has put message up on the uni notice section telling students and staff that they need permits for holidays too without updating the parking regulation document???

Please help, I am pretty sure that I am not in the wrong, they are.

    You need to stop worrying so much about what the 'regulations' say, and answer the following questions:

    1) Which company has issued the tickets, or was it the Uni?
    2) Do the tickets mention the Protection of Freedoms Act?
    3) Were the tickets stuck to the vehicle or did they arrive through the post?
    4) Where was this?

    Also, unless they were issued by the police or a council they are not fines, they are speculative invoices.

    Are the parking charges issued directly by the University or by some parking company (and if so, which one?)

    I agree they haven't a leg to stand on, the parking regulations are as plain as the nose on your face. Interestingly the parking regs also contain these gems:

    Penalties and Sanctions

    1. Non-compliance with any aspect of this policy may result in a Civil Penalty Notice being issued in

    Payment of the Civil Penalty Notice is £60 reduced to £30 if paid within 14 days. Payments can be

    CR2 1JX or by phone by calling 08443040005.. Full payment details are shown on the Civil Penalty

    issued plus any removal costs incurred. Abandoned or long term offending vehicles may be disposed
    of according to law.

    3. The issue of Civil Penalty Notices is undertaken by trained University personnel. The collection of
    penalty charges will be carried out on behalf of the University by First Parking in accordance with the
    instructions issued by the University.

    1. Its a private parking company, First Parking
    2.It does not mention protection of Freedoms Act just Data Protection
    3. No the tickets were stuck to the car door
    4 It was at the Uni park car in Hampshire

    Ok, in that case the suggested advice at this stage is to wait for the notice to keeper to arrive through the post in 29-56 days time. You should receive one for every ticket you received (I have assumed that you are the registered keeper of the vehicle).

    You will then need to appeal the tickets individually using the first appeal template in the Newbies sticky thread. Then, if these appeals are rejected you can appeal to POPLA (this forum has a 100% win rate at POPLA).

    Do nothing until you get notices in the post from First Parking. Don't bother with the university since they clearly don't know their a**e from their elbow.

    When it comes to sending First Parking packing (which you will do after you've received notices in the post) it will be important to stress to First Parking that they may not release your personal details to the University otherwise they will be in breach of the Data Protection Act and will be reported to DVLA and ICO. This is important because universities have a nasty habit of telling students that they will not be permitted to graduate if they have outstanding parking charges, but the legal reality is that, having obtained registered keeper details from DVLA First Parking must not pass those details on to anyone else.

    Yes the car is register under my name and I've had parking tickets before and I haven't received anything through the post?
    Are you sure they will send me a notice through the post?

    The Uni parking officer was clueless when I spoke to her, she said that I had to email First Parking and when I did, they contacted her immediately and forwarded parts of her email to me about the parking notice on the Uni page. Do you think I can phone her tomorrow and convince her to cancel the tickets by stating a few Parking acts etc because I really think they are in the wrong by not updating the Uni Parking regulation document and she has the power to cancel them?

    I'd be interested to know what you mean by 'Parking Acts'.

    What did you say in your email to them (would've been helpful to know you had done this at the start)? Did you identify yourself as the driver?

    I wouldn't bother with the Uni any further, they are obviously useless/powerless.

    Good grief, sounds like you've made a total mess of this already. You shouldn't have contacted anyone until you'd received a notice in the post, and if you never received one you'd have been home-and-dry.

    If we're to help you out of this mess I think we need to see:

    - a copy of one of the tickets (redacted of any identifying details)
    - what you emailed to the University and First Parking, and what you received back from them (again, redacted of any identifying details).

    Until then we're just guessing as to the situation.

    The Uni does`t know who I am, she asked for my name, I gave her my nickname.

    This is what I sent the parking company as she told me to email them and they should sort it out.

    Dear First Parking

    I am emailing you regarding three recent parking penalties that was issued to me at ..... University.

    I am a ....... University student and I have access to the University parking regulations which clearly states when the parking regulations apply, please see below and attachment.

    "The Regulations apply during term time only (23rd September 2013 to13th December 2013 then 13th January 2014 to 4thApril 2014, then 6thMay 2014 to 23rdMay 2014) on the King Alfred College and West Downs Campus from 0800 to1600 hrs week days and at all times throughout the calendar year at the Sports Stadium. The limited parking at the Winchester stadium is managed by thestaff on duty in that location,with enforcement throughout the year between 08.00-22.00 each day".


    I have spoken to the University Parking Office and I have been informed that I should not have been issued with parking tickets specially when I had my student ID on display. However I was advised to email you in order to solve this matter.

    I have spoken to the Parking Department at the University; please see the notes below regarding the parking restrictions:



    Yes, they have to display a permit. We have put messages up on the Portal (which comes up instantly as soon as they log onto their Uni accounts) stating that they have to display a permit. I think this is the chap I spoke to this morning. In fact I stated that he had to have a permit and also stated that we put messages up on the Portal ! Although the Parking Regulations have eased as it is (technically) Summer Hols, we are still having to manage the car parks to stop the Hospital staff parking on our Site, so by asking people to get a (free) temporary permit which will cover them for the whole holiday period, this should regulate who uses our spaces.



    Due to the regulations being documented on the University’s intranet; unfortunately the PCN’s issued will not be cancelled. You can appeal the parking charge notices either in writing to First Parking LLP, PO Box 3322, South Croydon, CR2 1JX or via our website
