Thank you mrs mac and others who replied :) I do need to ask for some advice please if anyone can help. I may be sacked when I go in work today. I'll try to cut a long story short, the manager has left the care home I work in and the owner has taken over as manager and made lots of changes including my job title, and my role. Now he wants to change my hours. For 4 years my hours were 9-2 but recently my old manager said I could do 9:30 - 2:30 as I wanted to avoid the traffic in the morning. I never had a lunch break and always ate my lunch at my desk while working. Now the owner has said I'm no longer allowed to eat at my desk, I must work 10 - 4 with an hour unpaid lunch break. I don't want to do this as leaving at 4pm would mean driving in busy traffic, I'd have no time to do chores at home and would need to change the time we usually have tea :( However I'm worried that if I don't agree to this he will sack me :(

Just be aware to ask the right questions if you only give them bits of info you may get the answers you want but it may not be the full story.

I do bits of HR and offer change of contacts periodically but always with help, but know there should be consultation. A lot of employers would prefer to retain trained staff Does your employer know that you have a possibly recognized disability as that may make a difference

Good luck and let us know how you get on X

I'm aware that he's not allowed to do this but I don't want to go down the route of unfair dismissal and tribunal as I went through this with OH last year. It was massively stressful and he didn't win. I just want to find another job ASAP.

My question is how many jobs are actually out there if I'm not fussy? I mean if I was to be left without a job I think I'd be able to find something within a couple of weeks if I was full time job hunting. I've done this before but OH points out that it was 5 years ago and it's not the same anymore. He says that many of the jobs advertised don't exist and that's why I'm getting no replies from them. I just don't know what to do. I want to stand up for myself over these hours because if I don't then where does it end. But then again I need a job or we cannot pay the mortgage. I actually only need to earn £700 a month so I'm happy to take a minimum wage job

I'm so confused now I don't know what to do when I go in work
Wait and see :D and it may be less stressful to look for another job whilst working 10-4 and having a slightly later tea ;)
There are not that many jobs out there and then narrowing it down to one that allows you to work 9-30 till 2-30 so you don't hit traffic will reduce it considerably ;)

Change is always unsettling and usually even more so for someone on the autistic spectrum so the first thing to do is try not to panic. It sounds as if you feel that by changing your working hours then you will have to change everything else in your life too and I can understand that is very difficult for you. try to remember that sometimes, once we have got used to a set of changes, they can actually work out to be better than we'd feared. Sometimes, we even find that once the dust settles we prefer the new ways.

Unless you are really unhappy with your new boss and the change to your role, it's certainly worth trying to find a way to make this work for you without going through all the stress and changes involved in finding and starting a new job. It might even be the case that your new boss is trying to make things better for you.

I think (but am by no means sure) that employment law states you MUST have a break every 4 hours so your previous boss was probably breaking the law by letting you work for 5 hours without a break away from your desk (even if s/he let you eat lunch there, that does not constitute a break).

If I were in your shoes I would try being extra charming to your new boss, thanking him for making sure you get a proper break but then asking if this could be for half an hour (which I am pretty sure meets the legal requirements). My dd works in a care home and she negotiated a half hour unpaid lunch break when her boss wanted her to take an hour so this might be possible for you too if you approach him in a calm and friendly way.

I would also try to 'sell' my preferred working times on the basis of benefit to the company/organisation. For example, has your new boss given you a reason why he wants you to start at 10.00 rather than 9.30? Can you think of any reasons why starting at 9.30 would be good for the company/organisation (rather than just convenient for you)?

If the new boss insists on you starting at 10.00 then perhaps you could do your chores at home before you go to work and then you could at least keep your tea time the same. Use your wonderful Aspie logical mind to work out the most efficient way to work round the proposed times. :)

If, despite all the above, you still want to change jobs then how difficult it will be to find another job depends largely upon what area of the country you are in and what your skills/qualifications are (as well as how flexible you are in the hours you want to work). Do you actually work as a carer or more the admin side? According to dd's experience, care work is relatively easy to find as good carers are in high demand in most areas of the country, admin jobs less so.

How many jobs have you applied for and got no response from? If it's 5+ years since you were last job hunting you may need to look at improving your CV to stand a chance of making it into the shortlisted pile. If an employer gets 100+ applications for a job then your CV has to be very good.

Best of luck and let us know how you get on.

Sorry I forgot to say good morning :o

Good morning :) (although it isn't for me, I have a headache now)

I think I will ask for 30mins but I really don't want to leave any later than 2:30. 3:30 will be worse than 4:00 for traffic because of the school kids. I end up like a coiled spring after driving in traffic :( I would do it for another job but I don't want to do it for him on principal. You cannot just change someone's hours and job that they've been doing for years, he's breaking the law. He's always breaking the law on many things he does and treats staff like crap. I'm sick of it and this is the reason the manager and deputy have walked out. When I've gone I'll drop him in the s**t from a great height for how he's treated all of us

Morning all! When I was working set hours in a shop a few years back, I was told that you were supposed to have an hours break after 7 hours work, and half an hour after 4 hours, so it does seem like a bit much to have an hour break after 5 hours work. The legalities may well have changed since then though, so don't quote me on it. Also, as Nenen said, your old manager was probably breaking the law by allowing you to work with no break at all.

Overall, I definitely agree with David. on this, it would be much easier to agree to it in the short term and then try to find a job that suits. If you have particular requirements on hours it will be more difficult to find something that suits as quickly as you would need to if you left your current job. Good luck!
