What to do now

i will do......but im a little impatient.when im trying to prove to them there wrong.and solicitor say ive a good case....but ive not heard of many cases like this .i just wanted advice on thoughts of users out there ..many thanks for listening.:)

The thing is you previously have been refunded £40k as you shouldnt have been sold PPI. But you are contradicting it now by saying you should have made a claim on the PPI. You cannot be rewarded claims proceeds and a refund.

You are right to persue consequential loses though. You say you want compensation but you have been refunded £40k which is surely more than successful claim would have paid you.

HI THERE ..I KNOW I TRIED TO MAKE A CLAIM BUT TOLD I HAD NO INSSURANCE.....i know i was refunded the moneys back for my policy...BUT..i had my hotel re posseded....so in fine detail..i payed the ppi up front all payed..and yes i got it back..but if it had paid out when it should have .thinking i was covered..i would never have lost my hotel and still been in buisness..and a big hotel to boot..that why i feel i should be compensated..i took the loan and BLRI..as a package..thinking i was covered then told no....so i struggled on paying loan till i could not any more loosing everything.i know this is not straight forward and complex but thats what happened..also as they now admitt i had it .i would rather of had a hotel worth a lot of money been in buisness makeing money instead of 13 years down the line re claiming that money ..that would not be enough to buy a shed...and its not my fault

You do not have a strong case to take this to court at all as you havent got your story straight. You know you had PPI and you had a claim declined for whatever reason which appears to be medical related from what you have said. If they said years ago there was no policy you have left it 11 years to take this to court. Why did you not persue this back then as you have known of the issues for a long long time. It would likely to be struck out as time barred now. Why has your solicitor not pointed this out?

You complained that your policy was mis-sold and have been given a £40k refund. You cannot claim a refund and also persue claim proceeds, consequential loses yes but this doesnt seem to be your argument.

Your argument is also flawed as its likely the PPI would have only paid out short term. Its most likely the £40k you had would far outweigh any successful claim that would have paid out, meaning you are due nil.

What would consiquental loss ..amounts to...i left it this long as i though i would owe the bank a lot of money from re possesion of hotel..and was frightend.my solicitor says the fact now they admit i had inssurance is a good thing.and yes short term cover on ppi..but it would have got me on my feet till i was better .rather than going deeper into debt and having no way out..

OK THANK YOU ANYWAY I WILL STOP MY POST HERE UNLESS OTHERS THINK OTHERWISE...but i just think its wrong im sorry if my messages wernt as clear as they should have been at times,but i just think its so unfair.as i would never have invested in my hotel and my life savings if this were to happen to me .some one should beheld responsible for me loosing everything.and i know its conflicting im my post .just tried to explain best i could.sorry for that.and paying back my policy is fine. but im sorry not enough.even if policy paid or not.i put convidence in the bank for the cover.and i did my upmost to claim or not to claim.to be told yes no .yes no..sorry you have no cover .and to prove all these years i did .im sorry some one to blaim as i did everything possible in my power .at the time it made me so ill with worry .could not do any more.as in them daysnothing like this ever went on...WELL IT DID .thank you .and end of my post by me ..but im living in hope as others who understand me think otherwise ......

WELL HI ..WELCOME AND THANK YOU..... im pleased there is some people out there that understands me even if it is a bit long winded and sounding strange at times..i was begining to fell a bit nocked back at some of the reviews ..but its all true.and should not have happened to me ,it did .and as anybody out there knows when things go wrong through no fault of your own its very hard to keep fighting.even when the big boys dont do for you what there supposed to do...they got there money off me ..i got it back .GOOD..but as ive posted many times.lost everything and it was my home ...A BIG THANK YOU..
