I came across wrong when I said all hell broke loose. My child pushed, was then slapped and then it went straight into the attack. The other child apart from the push was not touched in any way, couldn't have been as it was impossible, their head was held down. So no, my child has not been punished.

Just to add, this has been an on-going problem, the school were made aware in January.

Why did your child push the other boy?

So your child started the attack, by pushing and provoking?

The local authority has to offer an education. This can be in the form of sending tutors to the student's house until they persuade a school to find room for the terror.

Yes, I had home tuition provided by the local authority for years due to illness.

Yes my child approached the other to ask them can they leave them alone (on-going issue). When the other child laughed mine pushed....

Perhaps the school are t taking it as seriously because of this, perhaps they feel your child initiated it? Not that for one minute that makes the other child's actions ok, but it paints some grey areas, rather than a black and white random attack.

If there was already a problem between them, why did your son push him?

I must admit that I envisaged something completely different when I read your initial post. If I was the parent of the other boy, I would expect both boys to be punished not just my son and I would not accept my son being transferred because he came off better in a fight that another boy had started.

Unfortunately when two boys fight, there are no 'rules of engagement' - the gloves are literally off. As with Fabforty, I would also call it a fight not an attack. This boy hit your son and kept on hitting, unfortunately your son put his hands on him first. I am not taking anything away from the injuries that your son sustained, and I realise that this might not be a popular view, but it might explain why so little appears to have been done. Depending on what else has happened, this other boys exclusion might not be as straight forward as it first appeared.

Are you joking? A push warrants a violent attack???

A push does not warrant a violent attack, but it does give context to why the attack happened. It puts the situation in an entirely different light, the attack was the result of provocation, albeit the response was excessive.

It also sounds like there is done history between the two. In this case, in the past perhaps teachers have noted issues whereas punishing one boy over the other may not be the appropriate action.

For a broken nose and suspected fracture to the eye socket?! Not reasonable force in response to a push, methinks.
