Another pathetic attempt to dress up damages as a fee.
Apparently paying £100 gets you permission to park without permission!
That's an important point to remember for POPLA stage, knightrider14. Here's a POPLA appeal with the same sort of issue stated:

Different PPC but the same sort of rubbish in pretending the charge is 'paying for the privilege' of being allowed to park without authority! But that's just one of several points to keep for POPLA stage anyway and you haven't even got there yet. Soon you'll be sending the template first appeal when you get their excuse for a NTK - which you can check for giveaway words like 'breach' 'contravention' and 'failure to comply' - all of which make it clear this is really a breach of contract allegation and so the charge must be based on a GPEOL.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Relevant parts of the notice:
Issued date: 28th May 2014
Date of NTK: 2nd July 2014
"... was parked in breach of the terms which apply ..."
".. those drivers who break the terms and conditions of parking ..."
".. under schedule 4 of the POFA 2012 ...keeper ..."New members, please refer to "sticky" threads that are alwasys "stuck" at the top of this forum0 -
Hi arabesque_101, what do you mean by the relevant parts of the notice?
I have looked at POFA 2012 and unfortunately I cannot see any additional comments I can add to the template letter, so I am going to send this as it is written on the NEWBIES sticky.
Does anyone know if there's anything worth adding to the template as I was parked in my own space?
Thanks0 -
Also can someone confirm that I'm ok to use the template as just had another read of the NEWBIES sticky and read the following:-
If no time to 'dig out flaws' in paperwork, just use our appeal example unless your PCN was from:
'Devere' (Bournemouth usually, e.g. at Castlepoint)
'District Enforcement' (Staffordshire University etc.)
'Secure -a-Space'
'Napier'
'UKCPM'
And as my NTK is from UKCPM just wanted to double check, I don't want to give this company any chance of being able to fine me for parking in my own space.0 -
Send off appeal as per the newbie thread.
We can deal with the extra information that the photos give us in a POPLA appeal of they do not cancel. You have some good relevant points in the POPLA appeal to cover.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Hi All,
Today after almost 2 months received a letter back from CPM saying my appeal has been rejected. I have downloaded a copy of the POPLA template to fill in and send off to them. Any advice would be greatly appreciated. I have linked pictures of the letter below.
They are stating breach of terms and have the audacity to actually try and justify charging me £100 for the pleasure of parking in my own parking space.

I really appreciate all of you're replies. I'm going to start wording my POPLA reply tonight tomorrow night. Just for info I used the standard template on the site as my appeal.
