Someone sending you an invoice you disagree with is not in itself grounds for a claim.

Bazster not sure why you wrote this 'cos the whole post was full of crass statements.....+ stating that BenefitMaster has written a better claim than myself bears absolutely no relevance to my claim except to say that I am stupid and naive....which I do not dispute but really was unnecessary....or that the PPC is stupid and naive...which I do dispute ;)

So Bazster why would Coupon Mad and Parking Prankster both suggest charging 18/hour if the PPC does not accept the appeal?

See if you agree with this (and for the sake of anyone else reading this). PPCs don't just send you a speculative invoice that you disagree with.....

PPCs send you an invoice + use laws to back up their invoice + send threatening communications with the consequence of legal action even when you are appealing the matter. These "invoices" have resulted in PPCs taking court action or CCJs being issued to owners of vehicles. These speculative invoices result in fear, panic and a lot of time wasted collecting evidence and researching on subject matter to become knowledgeable in order to defend yourself against an invoice that should not have been such a big deal in a small part of your time line. Note: time taken to defend can easily expand into about 20 hours not to mention the worry and concerns that every motorist has thinking they have a parking fine.

The whole PP industry stinks and POFA is totally rank....created to screw everyone who owns a car. You already know that PPCs are screwing people's lives using POFA regulations.....then in my opinion everyone has a right to stake a small claim against a PPC.

P.S. Hope you watched the youtube video on the difference between male brains and female brains that I posted :) - think you'll agree.

p.s. ....and this stupid and naive person who knows nothing about laws and created an ill-formed claim was able to negotiate an out of court settlement of a reasonable sum.....this means there is hope for many more!!!

A similar case to yours gerty.

    Surely a mere coincidence. :)

You are being a bit crass Mr. B, I think that it is perfectly appropriate that, if you receive a PCN which you know will succeed at PoPLA, and you warn the PPC that, should you prevail, you will claim for your time and effort, then you can claim for a reasonable amount of time which you have spent on it.

PPCs know full well what wins at PoPLA and if they perdist, ythey must pay for their intransigence.

Before I retired almost 20 years ago, my employers charged for my time at close to £100 per hour out of office hours, so £18 an hour of a hobbyist's time does not appear unreasonable.

So Gerty, you won an out of court settlement, well done, did you accept a confidentiality agreement?

Additionally if it had gone my way, there would be a legal precedence for everyone to claim back from any PPC

Just to pick up on this one point ... no there wouldn't. Small Claims Court doesn't set any precedences.

But well done on your victory! :)
  • Baz - all good banter - would have stopped at post 32 but wanted law illiterate motorist folk to know there is a chance to stand up and fight if they put in the time to learn. However gave the sums about what a potential loss would mean as agree that folk could lose as well.

Bod - thanks - I am a law illiterate - though an early concern was slipped about being hit by more claims!

D - I can blab all I want however think there was a 50-50 chance the hearing could have gone either way so am approaching with caution to say that my way is the highway. Me thinks my approach may have been pretty unorthodox. It would require a blog
