The KADOE contract which governs the DVLA releasing data to the PPC's simply sets out that the requesting PPC must be a member of a Accredited Trade Agency (ATA). This ATA must be recognised by the DVLA (currently only BPA and IPC). The PPC must then comply with any Code of Practice set out by that ATA (but that appears to be a bit of a flimsy guarantee). There is no provision that an ATA be independent. This isn't completely unique to the world of PPC's however, there are various other trades where the accredited bodies are in fact just 'members clubs'.
There is a link in the first post of this thread to a copy of a KADOE contract: https://forums.moneysavingexpert.com/discussion/48903080 -

Vinci ticket in Morriston Hospital for £40 and £20 the discounted part, they only get 15% of the ticket whilst the hospital gets the rest, I suppose the £20 could be the costs, but then I appealed it and they dropped it like a hot potato, I wonder why ? lolWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

There was also a company mentioned in another thread (I can't find it now), who will only be charging £12 (increased to £20) for a 'breach'. How honest/professional this company is though remains to be seen.0 -

So as it stands am being offered 10% of my claim! (court has not happened yet). I am considering agreeing on a lower sum only if some terms and conditions are applied. I need some help here to what is fair and reasonable.
1. The PPC agrees to provide free motor services parking to everyone who provides a receipt that proves they were a customer if they feel their terms and conditions have been breached.
2. To stop harrassing motorists with pointless letters and providing a clear 35 days to make their appeal. I did a poll on a forum that has nothing to do with this kind of stuff and it should that nearly 50% of folks who paid a parking charge did so because they thought it would affect their credit rating + they thought it was a legal charge.
3. If a charge is to be made it can only be to a max of 15GBP (would be their 10GBP charge + a bit for admin)
Anything else?**********************************************

Well done on getting this far.
I'm pretty sure they would rather pay the whole of your claim than agree to that lot!
How exactly did they offer you 10%? Was it "without prejudice"?Je suis Charlie.0 -
No such words mentioned. Anyway I thought I'd try and then for every motorist that gets terroised and reports on the forum, they would have to put 10GBP into a fund of some sort!**********************************************
