I think you can be 99.9 per cent certain they do not own the car park.
Another alternative - which I am sure that many here disapprove of - is to write to them and offer them, say, £20 in full and final settlement without admitting any liability. There is a cost to you of a very lengthly process with POPLA. Given that your actions were not entirely 100% morally correct, I might be inclined to do this on this occasion.0 -
The information above is confusing.
There is NO financial cost to you going to POPLA. It is free for the driver. There is however a cost to the PPC, which is one of the reasons we love to see them losing at POPLA. Once appeal is sent off, you can sit back, relax and know you will win is you appeal on all the right legal points. Not circumstances. A win should pop through your inbox/door in about 8 weeks time.
I wouldn't advise offering payment. I have decided to wait for the NTK letter from the PCC. I will then follow the procedure detailed in the NEWBIES section. I will keep you posted of my progress.0 -
Just to be clear, POPLA is the second stage appeal, not the first to the PPC. You haven't done this yet as you haven't had the NTK. Just had the standard formal demand from Armtrac security, it falls outside the timescales for NTK (PCN issued 27.5/14). I will send the standard template as the keeper of the vehicle, they probably will not send me a POPLA code as they want me to sign a declaration of who was driving the car!! In addition i intend to complain to the BPA for them not following their COP.0

Make the complaints that they are demanding the driver details as well, make the complaints to the dvla also, copy the letter they sent you to them. The dvla has warned parking companies over thisWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

This is a prime example of why we always say to wait for NTK unless it is a hire car etc. There is always the chance , as has actually happened here, that they won't send the NTK within the time frame required by law for keeper liability. So there is no way they can take this further.
When you send in appeal, add a point d ( or you could make it point a and bump the others down) that there is no keeper liability since the NTK was received on day xx which is outside the time frame demanded by POFA12. Or better words to that effect.
