PCN Company Claim POPLA Rejected Claim

Say nothing, they know that it is they who have a mountain to climb, just let them get on with it. Judges are becoming wise to the lack of merit of these greedy PPC claims.
If they did send you court papers, it is most likely that they would back out before crunch time. You never know how far you can go until you go too far.0 -
How does this sound...
You are correct that this matter has been outstanding for a considerable time, so I will try to speed the process up for everyone.
“The charges applied to you by issue of this CPN relate directly to our ‘Genuine Pre Estimate of Loss’ (GPEOL).”
Your client’s GPEOL does not conform to contract law. In fact, the charges they are attempting to claim are not based on GPEOL at all. Furthermore, because the tariff was paid for the car park, in full, there was no initial loss; even if your client did conform to the correct GPEOL legislation.
Please inform your client that, now I have a better understanding of penalty charge notices and the companies involved, I will accept either a new POPLA code (which neither POPLA, nor BPA, ruling prevents), or a court summons date. I do not expect, and will certainly not respond to, any further communication from Car Parking Partnership, regardless of the colour the letter is printed on, unless either of these documents is supplied. Please also be informed that, should I receive direct contact from I.C.C Legal Services in the future, I will be reporting the company to the Financial Ombudsman Service for harassment.
Regards,
