PCN Company Claim POPLA Rejected Claim
Comments

Hi Coupon-Mad,
Yes, a bit gutted I hadn't found the templates first. But, I don't actually know I have lost. Never had anything from POPLA to say my appeal was rejected. Will get in touch with them and let you all know what they say!
Cheers,

There may be an email in your spam or junk folder, if you submitted your case online.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Waiting on official confirmation, but seems my POPLA appeal has been rejected.
Is that the end of the fight for me? I still very pretty angry about the original PCN!
Also, as I have only received details that this was rejected, can I appeal against the £30 fine the debt collection company has added on?0 -

IT'S NOT A FINE !!!!!!!!!!! :mad::mad::mad::mad::mad::mad::mad::mad:
If you have lost the POPLA appeal then all you do is ignore the ridiculous letters you get ( unless it is court papers but this bunch don't do court )."The darkest places in hell are reserved for those who maintain their neutrality in times of moral crisis." - Dante Alighieri0 -
Popla decisions are not binding on the motorists, so the next step is too ignore this intimidation attempt at extorting money. This lot never do court, debt collectors are powerless, so just file the letters get on with your life! When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Sorry Hot Bring - slip of the keyboard!
OK, I will be brave and ignore all letters received. Never done this before, so naturally a bit nervous it will effect credit rating / I'll end up in court paying a huge fine.0 -

You still tipsy ? As you've done it again
It can only effect your credit record if :
> They take you to court ( which this lot have never done )
> They win ( which is unlikely )
> You don't pay what the court says within 28 days ( which of course you would assuming they took you to court and they won )"The darkest places in hell are reserved for those who maintain their neutrality in times of moral crisis." - Dante Alighieri0 -
It has definitely been rejected...
Reasons for the Assessor’s Determination
At 12:47 on the 14th May 2013, the operator’s employee observed a blue *** with the registration mark, **** parked in the *** Hospital car
park. The operator recorded that the vehicle had not parked in a designated parking bay and was parked opposite a row of parked vehicles. A parking charge notice was issued for causing an obstruction to others.
The operator’s case is that there is sufficient signage in the car park that states that vehicles must be parked within a marked bay. The operator states that the appellant was parked outside of a marked bay and was causing an obstruction and inconvenience to others as he was parked across from a row of vehicles.
The appellant has stated that despite looking for a space in the car park and
paying for the car park, he was unable to find one. As a result of this, he states that he parked in an area of the car park that would not cause an
obstruction or be an inconvenience to others.
The operator rejected the representations on the basis that vehicles must be
parked within a designated bay at all times as per the signage and the
vehicle was recorded as parked causing an obstruction.
Considering carefully all the evidence before me, I must find as a fact that on this particular occasion, the vehicle was causing an obstruction as it was parked across from a row of parked vehicles; as a result of this the vehicles parked in the designated bays would have encountered problems reversing out of the space with the appellant’s car parked where it was. By parking where it is likely to cause an obstruction and parking outside of a designated bay, there was a clear breach of the car park conditions which the appellant
was aware of.
Accordingly, this appeal must be refused.

haha! Sorry! Wouldn't it become a fine if it went to court though?
Good to know it won't effect credit rating. Fingers crossed I wont' be the first taken to court!0 -
