They CAN tell when you are "tethering"
Your MAC address gives it away......
Otherwise how can they limit you to 1Gb @ £5 ?
I would say that "tethering" is "tethering" and you will be caught and charged!
My question was what is the difference between a tablet and phone ?0 - 
            Their is no legal definition .
Basically a tablet is recognizable by its size and may not include a phone/ sim component .
Phablet is just a name given by the press to a very large screen phone .
Probably the initial handshake identifies the model .0 - 
            So what's to stop you from using a SIM in a Galaxy Note 8.0 which offers GSM phone as well as the usual tablet stuff - in fact it appears to be virtually the same as my own Note 1 only bigger and faster............
They can't demand that you use a data SIM0 -

Because Samsung class it as a tablet.

How does your MAC address give it away? It's still the phone connecting...
I haven't done much research on this but I think the phone automatically switches to a different (hidden) APN when you activate tethering, which is how they detect it.
Using FoxFI seems to work for me in getting around this - although I don't use it a lot as I don't want to pop up on anyone's radar. There are other methods which could be employed to detect tethering (such as examining the network packets) but these are difficult to automate.Let's settle this like gentlemen: armed with heavy sticks
