    My first question is, does anybody know if there is a way of working out whether you are entitled to cancel, or should I be ok to just presume this is the case and send them a letter anyway. Presumably if I am not entitled to back out at no cost they will let me know?

    In previous times this has happened the network has taken a look at your prior spend for the last few months to calcuilate if this will impact you.

    Rremember this is calls out of your allowance that have gone up, If you have not exceeded your allowance then there is no increase to you so its unlikely you would qualify.

    Secondly, is there any chance that Vodafone demand the iPhone 5 (or at least it's current value) back? Obviously it is no longer in my possession so I cannot return it. If it makes any difference my contract is around a year in now.

    In this case probalby not. The phone is yours from day one, however in some cases the network may ask for the phone back instead of any early termination fee for leaving early.

    I'd also suggest you go and read your contract. If you upgrade arly usually the 2 to 3 months get stuck on the new contract..

    Speak to Vodafone. Even if you are tied into a contract they will still be able to reduce your tariff for you for the remainder, although they usually allow a one-step downgrades so you might get £5-£10 a month off.

    This is very unlikey, theres no harm in trying but for at least the last five years (since the Your Plan series came in) the T&C clearly state there can be no reduction until the minimum term has been met.

    If you get anything it may be as a goodwill gesture.

    As they are changing the terms of the contract, surely you have a right not to accept the new terms, regardless of whether you do or dont use more than your allowance.
    If I called Vodafone and told them I would only pay 90% of my bill next month they would tell me no, they would not accept my terms, a contract is required to be fair to both parties. Why should I accept their new terms?

    11b) You may end this agreement by writing to us if:

    we don't do something fundamental that we should have done under this agreement (for example, if there is a complete failure of the entire UK network for seven days in a row due to something we have done), within seven days of you asking us in writing;
    we tell you that there will be an increase in the plan charge (calculated before the addition of VAT or other levy) and you write to us within one month of us telling you about the increase;
    we change this agreement to your material detriment. This includes (i) increasing charges in the UK (calculated before the addition of VAT or other levy) which has the effect of increasing your total charges (based on your usage in any of your last 3 bills) by more than 10% when compared with the charges 12 months prior to the increase; or (ii) changing or withdrawing services. We will tell you if this is the case. You need to write to us within one month of us telling you about the change, withdrawal or increase. This does not apply if this is a change to or withdrawal of third party services not included in your plan, which we and you can cancel (or stop using) without ending this agreement.

    I've tried before with this detriment clause,onlinechat agreed- they sent a pac by text.Letter arrived over a week later reminding me i'd pay over £300 if i used it!.
    Ombudsman backed vodafone up,in fact it sounded like they were going to back up the telco all along - wonder who pays for the ombudsman?????

    The ombudsman was a complete waste of time,the person I dealt with agreed he didn't understand the contract but his finding against me was still the final verdict.

    Hi,
    I'm a Vodafone customer and I'm hopeful that one of these texts that are being sent out will, come to me so I can "get out early".

    The main problem I have with this is ... "Vodafone will estimate how much bills will rise based on a three month profile of each customer's bill."... what about costs going forward?
    The facts or details of what services I've used in the past 3 months, which Vodafone will use to determine whether they think I'm affected or not, are surely irrelevant? They cannot predict how I'm going to use my phone going forward and therefore the price increase will/could affect me. They are making changes to the contract, end of!

    Thoughts please?
