The fact that you call this a 'fine' is just one indication about how little you seem to understand any of this. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I am trying to help, I'm saying don't park longer than is allowed it's pretty clear.
Learn from the mistake of not abiding by the rules of parking in that car park, pay the charge and get on with life.
If it's not a fine what is it?, it is a charge for breaching the terms of parking in that car park , sounds like a fine to me.. ..

Telling people after the event is hardly helpful to the position they now find themselves in (I always wondered why you chose that particular forum User Name!).
Best would be that you start a brand new thread with your revolutionary method of avoiding parking charges (or even 'fines' if you want to call them that), then I'm sure you can stimulate a great debate on your 'blue sky' thinking.
And then you could change your User Name to captainforesight! :rotfl:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

What other alternative is there? How can you give advice about something that has happened before it has happened??

Yes the lease company are probably in the top 5 biggest in the country. My work have a massive contract with them so we have our own dedicated contract manager at the lease company and she is dealing with this. She seems very compliant with me when asking not to pay the bill but seeing as they named my company as the driver and its now outside of ECPs 28 day 'name and shame' period, they seem to want to chase my company (via the lease company) instead of my self despite me owning up to driving at the time. My company are very concerned that ECP will take legal action against them so i don't want them to pay up just to keep them at bay.
Ive had a email back from the stores customer services team and am to expect a call from the store in questions manager tomorrow with a resolution so we will see how that goes!
I am assuming this is in England/Wales and so are the lease firm? If so, the lease company will very likely be members of the BVRLA (check on Google). Read this:

Your work should not be wasting time thinking it's a 'case' to be involved in, IMHO they should ask the dedicated contract manager at the lease firm what they are playing at because:
''The Protection of Freedoms Act 2012 enables you to discharge your potential liability in one simple letter, passing on the driver's details to the company who has sent the notice. The BVRLA actually instructs its members to do this as good practice - it means you receive no further letters as the charge becomes the driver's issue. Private Parking firms cannot revert to you under POFA 2012, once you have given the name and address.
Our driver is and was more than happy to allow you to pass the private firm his details so that they have a tangible name and address to pursue. This also absolves yourselves as the owner/keeper from any liability - surely this should have been your default policy for private parking tickets in England & Wales for two years, since the POFA 2012. Under that Act, as a lease firm you are supposed to send the details within 28 days and you would hear no more and have no liability. We do not understand why this has been allowed to drag on so long; and why it has been down to our driver to research the law for you? It should not be your policy to do anything other than to pass on the driver's/hirer's name and address immediately by template letter. Indeed your current stance leaves you vulnerable and denies our drivers their own chance to appeal and ultimately to get these worthless invoices cancelled by POPLA or other independent appeal.
These are not real PCNs, not at all like real penalties/fines from a Council or the Police - and as a BVRLA member, your approach to them should be consistent and speedy, to ensure you are never pursued further by these notorious firms and so our drivers can handle the issue and appeal to POPLA, as is their right.'
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the reply!
Yes, this is in England and yes the lease company are a member of the BVRLA.
Thanks for the info. Im still in waiting to hear from the store as that should be the easiest route to go down and saves me arguing with people at work and the lease company but if that falls through, ill be going down that route.0 -

Well done harni, I expect Captain Cartoon will be along shortly offering his congratulations, or perhaps some more sage advice. If you'd listened to his last lot you'd have been 120 notes down now.
What say you Cap'n?
@harni, make sure you keep hold of that email cancellation; what you really need is confirmation from ECP which may be a bit more difficult to achieve.
Whilst legally you're done and dusted, my instinct is that you might not have quite yet heard the last of this. Do keep in touch via this thread if anything further comes through. Please note, we are not a legal advice forum. Thanks
Yeah I've kept the email and have also forwarded it onto my lease manager so they have proof. If any more is heard from ECP other than a confirmation of cancelling the fine, ill get onto wickes again to get them to double and triple check its cancelled.
Thanks again all!0
