    DRP - complete waste of time, breath and emotional energy. You'll get no positive outcome. At best you will encourage them to send you more ever-threatening letters, you may even get some really scary ones in red ink. But you'll get no satisfactory result.

    It would be about as much use telling this to DRP as making tea in a chocolate teapot. To be honest it would probably create the same coloured mess though.

  • Thanks. I rather thought that might be the case but wanted to be sure before I ignored it. Will draft my letter to BPA over weekend. I'd like to quote the exact number of the COP rule they've breached by sending me this letter while awaiting POPLA ruling. Anyone have this to hand to save me some digging?

    Here's a link to the BPA CoP. Have a read through it as there may be other issues of breach you might spot - you know your own case better than anyone here.

    There's also an index on page 3 of the CoP which might help narrow your search. The more you get to know and understand about all this stuff, the better and more successfully you will be able to deal with it.

  • Thanks. Yes I was going to include a few other breaches while I was at it, not least the 6 weeks it took CPM to reject my appeal in the first place.

    I received the good news on 26/9 but was on holiday. Here's the official response:-

    'The Operator issued parking charge notice number xxxxxx arising out of a presence on private land, of a vehicle with registration mark xxxxxxx.
    The Appellant appealed against liability for the parking charge.
    The Assessor has considered the evidence of both parties and has determined that the appeal be allowed.
    The Assessor’s reasons are as set out.
    The Operator should now cancel the parking charge notice forthwith.

    Reasons for the Assessor’s Determination
    It is the Appellant’s case that the parking charge notice was issued incorrectly.
    The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
    Accordingly I have no option but to allow the appeal.

    I decided to wait for the outcome before sending off a letter to BPA but now that I have a positive result I will delay no longer. Will probably have a moan to DVLA as well for having CPM on their 'approved' list.
