My family and I were shopping yesterday for football shoes/trainers and went to our local sports shop DW sports and found a nice pair of trainers for our little girl which she chose and tried on, they ticked all the boxes and was delighted to see the price was £39.99 to £24.99 we also required our items from the same shop to the princely sum of £80 plus, we inquired about the priced charged for the trainers and we're told they were £29.99 and not £24.99 (still a good price) as listed on the display I queried the price and the assistant said customers move shoes around and £29.99 was the correct price, I pressed further saying they can't advertise shoes for sale at one price then change the price once you reach the till it was then I was rudely told by the manager who was serving another customer that he could refuse to sell them to us if he wanted, not wanting to upset my little girl I resisted walking away but took a picture of the display from where I found the trainers with the price clearly marked and took the price off and gave it to the assistant saying take this so nobody else falls fowl of this misleading price, upon leaving I asked for the managers name and the head office number so I might contact them to complain about the way I and my family were treated this day, very annoying.
When we got out of the store my wife told me she had taken a pic with the trainers in place.
Surely this is mis-selling or false advertising??? Any help and /or advice would be helpful and gratefully received.

    This is the important bit. Customers could easily go into stores and move price tags around and get things for cheaper if the law allowed what you want. Fortunately for shops, it doesn't.

    The staff shouldn't be rude about it, but apart from that they were completely correct.

    The photos are of the display as we found it entering the store and you can clearly see the space left by the trainers we bought, please forgive the quality of the picture as I was very angry at the time

    Do shops have to sell goods at the advertised price?

    The simple answer is NO!

    - you cannot force a shop to sell you something

    - this applies to correctly and incorrectly priced items

    - this applies to ALL types of shops - whether they are online internet stores or offline physical stores

    - internet shops can to refuse to honour prices even after they have taken your money

    - if you think a retailer is intentionally trying to misleading with pricing then you should report this to your local Trading Standards, which can be done via Consumer Direct (08454 04 05 06)

    Thanks for all your input, Jim you make a valid point with regard to the price label I think I might just email them with regard to the customer service I experienced on that day it has probly put me off that store in the future. Thank you all very much appreciated

    I don't think you received poor customer service but factual information.

    Did they apologise? What was their attitude like?

    The manager may have been short with you as he was with another customer so didn't have time to go into detail.

    I don't know why they haven't put a description on that label to say which shoe it applies to but well within their rights to refuse.

    Also £24.99 seems very expensive for children's shoes! :)

    Well I felt the experience on the day wasn't up to what I generally would expect, yes he was with another customer when he interjected so I tried to speak back to him in response he then indicated that he was with another customer blanking me if you like. I then informed him that his floor staff had been very helpful but it was a shame the manager was so rude, I thanked the staff and walked out with my family.

  • This happened to me in peacocks on the weekend. I went in to buy a belt. There was a rack of clothes near the till that stated 3 pound and under. I picked up two pairs of jeans. Two pack of cropped leggings & one top. When going through the till the cropped leggings came up at 6 quid and one of the jeans came up at 7 quid. I queried it and the manager said that the items did not belong on the rack and had been marked down by mistake. I stood my ground and said mistake or not they are clearly marked 3 pound. I have to admit I did not know about legal rights etc but I argued it, she was clearly not happy but did honour the prices for me.
