Just thought you would be interested in This update.

I have now SUCCESSFULLY managed to get my judgement set aside after an initial court hearing and direct dealings with a compassionate ParkingEye who have helped liaise through the court to agree a consent order for judgement to be set aside.

The District judge agreed this and I have now received confirmation from the court.

I appreciate everyone's help, but moving forward unless you are 100% correct when giving advice, do not give advice. I could have somewhat been hindered by certain above comments stating it would 'not be removed', clearly this is incorrect advice as a proven case.

Do not give up, you can certainly fight a CCJ regardless of people's experiences, I am very happy to say I am now CCJ free.

I understand this forum is to discuss problems and help each other find resolutions, I hope this case can be somewhat helpful to others stressful situations wondering if removal of a ccj is possible - it certainly is, feel free to get in touch.

    Thanks for the help guys.

    Regards

Well done, we can only advise on in general as we obviously don't have all your details at hand in relation to this. But I think you have had this done by luck to be honest, and it is an anomaly normally from what I understand of it. Most judges will not consider it once a judgement has been made, and been paid.

But I am happy for you. Next time it happens please come here as soon as you get the ticket for advice, even if its from a council.

    Well done.

I'm assuming you had some sort of compelling story for ParkingEye to actually agree to a consent order. Nevertheless this is a great result.

    2 questions if I may:
    1) What has been said about returning the money you paid?
    2) Will ParkingEye be restarting the case (this time with the correct address)?

    Thanks guys, much appreciated.

In answer to your questions da_rule:

A mutual agreement has been made for no further cases to be reopened and ParkingEye agreed not to reopen case and helped with the removal.

Secondly, I will not be claiming back the monies as I appreciate ParkingEyes compassion to go out of their way to contact the court and agree to request the judgement to be set aside. As much as it has cost me 165 for the ticket and 80 for the hearing.

I built a good case that relied on some compassion for my situation, either way politeness and cooperation goes a long way.

    Many thanks

But look at it in this way, Parking Eye has got your money, they don't give a monkeys about compassion, they may have parking in their business name, but trust me they are not in that game they are in the money generation game, and they will come at you again. We have a slogan for them

    Parking Eye
we are coming to get you

ParkingEye and compassion are two words I have never heard put together before ... Unless it was dreamed up by ParkingEye's spin doctors.

You have just paid out £165 to your tormentors .... And you are grateful to them for their help?

Jeez! Compassion you think? They have £165 of your money. Rarely read such a pile of drivel in my life - you actually think that is OK and even a good thing?! What a terrible outcome for you, horribly stung and out of pocket and yet coming here to try to convince us that PE are 'compassionate?! WOW.

So here's how I see it.

I joined a forum to seek advice from 'experts' about a topic that did not state anything around financial loss, other than job loss and family security..

I received some great advice which I followed up by a kind chap who helped at no cost.. I also received some poor inadequate advice from individuals who clearly believe in speaking before learning.. Fortunately I come across a lot of your type and chose to ignore.

I then get further individuals who now wish to be rude and sarcastic towards myself and my position, forgetful that I was merely seeking advice from a forum of experts..

For anyone else in the unfortunate position of having been penalised by a ccj, take note that it CAN BE FESOLVED despite other 'experts' inadaquate advice..

This message will no doubt be deleted, but fortunately I am leaving now anyway.. Jumping in the Bentley to go for dinner with my stunning wife...

Enjoy your blogging from behind your computers, don't be on here too long, Call of Duty is no doubt missing you.

    Regards

    Josh

joshfsc - as long as you got a resolution that you're happy with, that's all that matters at the end of the day and congratulations for getting it.
