Free Phone by mistake?

So I ordered an upgrade about a month ago, as per usual I searched around for the best deal and it was from mobiles.co.uk. I intended on staying with O2 so used the upgrade option through the mobiles.co.uk website. Everything went as expected, ordered Galaxy S5 several days before release and was told I would receive handset after checks with O2 were completed and of course when the handset was available after the 11th of April release date. All good.
Handset received about the 14th April and I followed the instructions to complete a "sim-swap" to transfer my number onto the new sim card provided. This was done and I expected my new 24month contract with new plan: data, mins, ect to show up in my O2 account soon. This did not happen, my old plan was still there, nothing changed....Still telling me that I was due an upgrade.
After contacting O2 all they wanted to do was sell me an upgrade!! And it turns out all they have recorded on my account was that I'd ordered a new sim card that was capable of 4G but this obviously wasn't any form of contract. I explained the situation to them that I have a shiny new phone in front of me but they just said I need to get in touch with mobiles.co.uk. In the meantime I changed my plan to a sim-only 30 day rolling contract as im not sure if they can backdate the costs when/if it is noticed.
So does anyone know what possibly may have happened? Im not making any conscious effort to get out of paying for this phone by any means whatsoever, but I will not chase up a subsidiary of retail giant carphone warehouse just to ask them to charge me! What im asking really is, could they backdate the contract charges if it is noticed in months to come? and where would I stand if I was to leave O2 (which i can do without charge at the moment)?

Mobiles.co completely incompetent. They failed to set the contract up (unless you find they have when you get the first bill) and are unlikelyt to notice. I've had free phones from them before. There's nothing stopping you from leaving O2 in any case. The only danger is that Mobiles.co will notice and ask for the phone back. That shouldn't be a problem; you will have used a different sim in the phone until the new contract sim arrived (won't you!!!) so IF they ask for it back (which I sincerely doubt) they will have to accept it back used.
I've had free phones like this from them before; although cheap ones, they were lost in their system and it never cropped up again. However, given the value of the phone I wouldn't advertise your good fortune on here!0 -

NO, this was simply to reduce cost incase mobiles.co.uk tried to claim back costs of contract in months to come. The £35 I was paying was for old contract and tariff could be changed. It made sense to be paying £15 rather than £35 just incase and these change in tariffs changed no details of mine and my account is still the same. I couldn't see it having any affect on dealings with mobiles.co.uk. It was genuinely me trying to reduce the possibility of receiving a hefty backdated bill. However like I say I wont be chasing them up about this, who would really.0 -

Yea, my offer came with £100 cashback also. Eeerm, probably wont chase that up either!!0 -
This has happened twice to me.
The 1st time I got a Galaxy S3 and the 2nd a Galaxy S4.......both times the quidco cashback came through within 30 days.0 -

Ive read back what I'd written I cannot see how I am being in any way unclear? I changed from my old tariff for which I was still paying for the cost of the phone after the 24month contract had expired. My new tariff hadn't came through yet so I was avoiding the possibility of having to pay for my old tariff and new tariff simultaneously. Its not as if I got my new tariff through and active then decided to change it, I wouldn't have been allowed and wouldn't even be posting here if that happened as there would be no issue!! I cannot be any clearer, if you still do dot understand then fair enough. Have a nice day!0 -
I was bought up as honest by my parents, at least notify them of the error, and if they decide to not sort it fair do.Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
