Returned faulty PC bought via Ebay/Paypal, Ebay refuses to refund

I got a faulty pc, no word from seller so opened dispute and they told me to return at my expense so I did so, when they didnt refund I waited till I could escalate and did so.

A few hours later I get an email from Ebay saying I am suspended due to suspicious activities and the claim closed in sellers favour.

So a £1200 pc is now been paid for and I have nothing.

What are my legal rights?

EDIT : Livechat told me users can only open 3 cases a year, and this is my 4th and since 2 items didnt arrive at christmas and a item came faulty in new year that used up all my allowance for the year.

Seems crazy or are they lying?

    So I should have ignored my refund that livechat

    Habitual returners are now getting suspended, even barred, Amazon do the same.

    There are too many scam buyers now that we are all tarred with the same brush. Having said that I haven't returned anything for about 5 years let alone 4 items so they have to protect sellers the best way they can, it would be unusual to keep returning items.

    Live chat are notoriously bad for their appalling grasp of ebay rules. Over and over again they give advice to us that if followed would have us banned- most people treat their 'advice' with a pinch of salt.

    OP, if you do ever come back to this thread please ask for it to be moved to the ebay board- not getting a refund is unheard of- just being suspended does not cancel any outstanding claim. There is a lot more to this than you are saying but I'm sure one of the regulars can help.

    Hi, all I know is that I got a suspension email mentioning "innappropiate" activities and all I can think of is opening 3 or 4 disputes in last 6 months

    Your claim should still be open though- if you have returned a faulty item using the ebay dispute process and can prove using online tracking that an attempt at least at delivery has been made the refund will be given.

    The only way a refund can be refused is if seller has overwhelming proof that you have either damaged item to force a SNAD claim, or have returned a different item. However, both of those are almost impossible for a seller to prove and in most cases, speaking as a seller, they find for the buyer first and refund- and then find for the seller later on appeal.

    Actually reading your first post you say you returned PC and escalated at that point- do you have online proof showing item was received, or an attempt at delivery made?

    If you can prove an attempt was amde at delvery you need to phone ebay and explain you have complied with their requirement to return.

    This is all a seperate issue from the suspension- that will stand unless you can talk ebay into relenting- but it does not affect the SNAD claim that was ongoing.

    Of course, but Distance Selling Regulations can only apply when the seller is a business.
