Disabled Bay,Meadowhall.

Hi all, Could someone help please? My wife and I went shopping to Meadowhall yesterday, she is disabled and we have a Motability vehicle, We parked in a disabled space and as I was placing the Blue Badge on the dashboard my wife had a 'coughing fit' , I put the badge out and rushed around to her, she was fine and we went shopping, On return I was suprised to see a Yellow sticker on our window, it was a PCN from an operative of PCM with a charge of £95.00 or £57.00 if paid within 14 days, The charge was for not displaying the disabled badge properly, I had in my panic to help my wife placed the blue badge wrong side up! Have I any hope of a sympathetic outcome of an appeal or is it better to pay the lesser amount? would things like Meadowhall is a free car park and there was many spaces available, Our Motability vehicle has a tax disc that states it is a disabled vehicle, have any bearing on an appeal. thank you for your time and any advice.

    of course you can appeal it , and many do

    but a BB isnt relevant on private land (no authority)- neither is the tax disk either ; but the EA 2010 is what is actually relevant

    you can easily appeal this and win if you read the newbies sticky thread at the top of this forum and follow the advice

    you should also complain directly to the meadowhall service manager as there have been many similar cases

    Trubster got compensation from PCM and Meadowhall for this illegal harassment, and The Blue Dragon has only the other week had a meeting with Meadowhall Centre Management who have realised that PCM are breaching the Equality Act and that they have a problem here with being disabled unfriendly.

    Start by making a cuppa and reading ALL those threads above (the links from Redx to MSE threads and my links to pepipoo threads) from start to finish, all pages, then sending the two posters I mentioned a pm (you would need to register on pepipoo as well but it's free & quick).

    It's easy to appeal and win (although PCM don't offer POPLA, they offer another version with the IPC instead of the BPA). But best to also complain to Meadowhall about this illegal harassment of an obvious disabled driver - as well as appeal to PCM using our template. A private firm has no business looking at (Council only) Blue Badges & pretending they have some sort of authority to judge if you can park in a a disabled bay or not. Like the other posters, get your car reg number(s) added to Meadowhall's white list of exempt cars in future - complain and insist on it!
