Yes, but they can also award redress. Not a "fine" though. That is a wrong way of looking at it, as they have no such legal power.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

i assume compensation is also available if capita/ventura mess up on behalf of erudio, such as going against the DD mandate?
Time spent chasing up the error by the affected is £10 or so per hour if i am not mistaken, or it was when my bank mucked up once?0 -
Wow. If I had a DD with these idiots I would cancel it ASAP and pay via another method, if indeed there was a payment due.:beer:0

I have also just posted off my forms and evidence for deferment - my deferment period ends on/around the 25th May.
So, given the fact that Erudio seem to be taking a long time to process deferments, would you recommend I cancel the DD I have set up?
Or, based on the assumption that Erudio will take money out of my account without informing me of DD date/payment amount - should I just leave it and claim back the money through the bank under breach of the DD Guarantee?
Thanks in advance!0 -
Well N&P my bank - HSBC who have gone beyond my expectations in dealing with this now, I contacted them on twitter about my complaint, they told me to do it properly via secure message on my account so I did.
I got contacted today to say that they have refunded as per dd guarantee, contacted the call centre team and retrained them in their approach to something like this and they have then credited my account with £35 as a way of apology and in compensation for any costs I incurred trying to sort this out :T:D
I haven't had a chance to contact FoS yet about Erudio but hope to be able to tomorrow. Work has just been far too busy today (HSBC rang me but was unable to answer due to being in a meeting)0 -
I phoned my bank back on Saturday and asked them to reinstate the DD to Erudio so they couldn't claim a breach of the T&C on my part. But I also said that I still wanted my money returned to me via the DD guarantee and my bank has done that now. They've also cancelled my DD to Erudio again without me asking so perhaps it is policy to deal with these cockroaches in this way?
What an absolute shambles - I am enraged that the government has sold my loans to this debt collection agency without due diligence!
Got my money back, though, which is excellent!0 -
And now today I've had 4 separate refunds (all approx £32) from Erudio - aargh, which refund do I return? HSBC which i had to fight for and ended up complaining about or Erudio - which could be difficult?0

Mine is as similar story but mine was because I never received my deferment form which I normally got around 11th march. Initially I thought it might be late because SLC had sold the loan, but then I called SLC and they said they had nothing to do with my loans ring Erudio.
Erudio said that they would send me a deferment form and a welcome pack. the welcome pack came 14 th april but no form. I then rang thesis as they have 2 of my loans and they told me SLC defer their loans and requested a form and put a hold on the direct debit.
In the mean time still waiting for form from Erudio when I checked my bank balanced noticed £36 had been taken. I rang them up, they told me it was a shared loan and that SLC was responsible for deferment, so I rang them and they told me they have nothing to do with the loan which was sold to Erudio, so I rang Erudio again and again they told me it was a shared loan and SLC were responsible for deferment, so I went round in circles not getting anywhere. Erudio said they won't refund any money until the loan is deferred but I could go to my bank and get it returned. (difficult when one works nights).
In the scheme of things it is not a lot of money but they are supposed to give 10 days notice before they execute the DD but I received nothing.
I have now received deferment form from SLC regarding thesis loans and faxed to them yesterday, I will have to see whether i get the dreaded 4 page deferment form from Erudio. I am getting a bit worried as I am being made redundant the end of may and don't know if the payment is classed as income, does anyone know.
Thanks G0 -
I forgot to add, when i rang Erudio and SLC I asked to speak to a manager but they said there was no one available, but they could get some one to ring me back, I took up the offer from Erudio to ring me before 6pm yesterday, but surprise surprise no one did0
