Hi all
Newbie here
Read parkingpranster's blog (awesome), read lots of forums to ignore or risk being the random one....so decided to use yr template appeal to the parking company. They of course rejected it and it is now with Popla.
However am wondering if any of you have sent the parking company an invoice for the 18/hour consultancy charge when they rejected your appeal? And if they didn't pay in a timely manner, did you take them to the small claims court. Would the initial letter stating that you would charge them for your time indicate a contract?

Both Vinci and NGP have paid out to victims recently, people who had the guts to send them a 'PCN' of their own! Worth the MCOL fee which you can reclaim as part of the case. The Parking Prankster blogged about how to lay the groundwork for this:
http://parking-prankster.blogspot.co.uk/2013/12/laying-groundwork-prior-to-reclaiming.html
And ParkingEye have BikerPaul on pepipoo on their case after they pretended they could invoke keeper liability at a site where...they couldn't:

That one is ongoing; he hasn't dropped it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think it's worth bearing in mind gerty, that companies such as Parking Eye have seen their profits drop from 31% to 7% in a year, as was demonstrated in the Cambridge Case.
Have you know compassion man ? Do you want to see these people go out of business ?
People at Parking Companies have feelings too you know.Illegitimi non carborundum:)0 -
I would like to know if they have compassion. I had appealed to them (submitted 12 days after receiving the PCN), they sent me a second demand notice 12 days after my appeal letter. 3 days later, I received a response to my appeal rejecting my appeal and providing me a Popla code.
10 days later they sent me a letter threatening legal action and have said it will be going to court. I had submitted my Popla appeal. I have compassion for companies that are ethical. I have no compassion for bullies. Would you have compassion in my case?**********************************************

Ivor Pecheque has that name because he has a cheque from ParkingEye. They took him to court and lost.
His post was satirical.
:-)
Having laid the groundwork for reclaiming your charges, once you win at POPLA (PE are not even defending at the moment if you put in a good appeal), then you send them a bill, followed by a letter before action if they do not pay up.
At this point, you then decide to file a court claim against them or not. BenefitMaster is currently going through this process, so it is worth waiting to see if he wins or not. Currently I believe he is waiting for the courts to set a date for a hearing.
If he wins no doubt he will publish template letters here so others can follow in his footsteps and the parking companies will have another set of templates to complain about.Dedicated to driving up standards in parking0 -

Read other posts by Ivor PE Cheque and think about his username - he was posting with his tongue firmly in his cheek although we know you won't have known that!
This is him:

Legendary win in court, with costs granted in his favour (as does happen fairly often when the defendants are well informed and are on this forum or pepipoo).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
