Invoice template for reclaiming expenses against ppc

In view of 2 successful POPLA appeals this week, I'm wondering if anyone has set up an Invoice template for the above please?
I'd be interested to see formats already used. Pleasing as it would be to use pe's business model back at them, it is defective:p.
This RK's losses are genuine and provable, as are the costs of materials, phone calls and I would put pe to challenge the time notes which have been kept honestly.

da_rule - haven't I read you invoiced[or thought about it?] an offending and dismissed ppc?

Constructive input welcomed - thankyou.

    I did indeed.

I just called it an invoice and put:
On XX (date) I appealed a PCN issued by yourselves (PCN Ref: XXX). As part of this appeal I informed you that should you unjustifiably reject my appeal and I was then subsequently successful in my appeal to POPLA, on substantially the same points raised with you in my appeal to you, then you would be liable for my costs in appealing to POPLA.

You rejected my appeal using the standard template response, you therefore failed to address the points in my appeal. I raised the same points with POPLA and was successful. I note that you did not submit any evidence to POPLA, you must therefore have known that your initial rejection of my appeal could not be justified. Therefore, you have, by your actions of unjustifiably rejecting my appeal to you, agreed to be liable for my costs.

Therefore, the costs which you are now required to pay for are:
The total amount due is £XX. Please send payment, by cheque (made payable to: XXX) within 28 days. Beyond this date the outstanding amount will incur interest at a rate of 5% per annum. Failure to pay by the stated deadline will result in legal action being taken against you. Yours etc

Hope this helps. It isn't exactly as I sent. I've improved on it slightly.
  • And are you actually going to back your words with a court claim......

It's no point sending a threat of a claim unless you are prepared to do just that. I don't think a template would be appropriate and if should be worded by yourself. Also how can you claim against just one party? There would be others involved like a retailer or landowner, and they are equally liable.

    Agreed.

They aren't really equally liable, in that the term in the appeal was only sent to Parking Eye. If the matter does go to court then Parking Eye can try and join the land owner/retailers as joint defendants, which I'm sure will go well.
  • So da rule are you actually going to issue a claI'm? Or all huff and no puff?

They would be liable as parking eye if a complaint had been made and the retailer/landowner refused to help, the point is that I can't see a claim being successful if the people owning the land are not there, after all they are the principle and parking eye the agents .

Thankyou all for input - just in and straight out again now.

To me, it is key that this was the Assessor's reason for allowing both Appeals, allowing a.n.other to correctly infer there never was any case of any kind to begin with:
'The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.'

I am away till mid-June after this week, but would be prepared to save from my pension on rtn to pursue this further. Yes, I know thousands of people feel angry about pe, but why should such chancer extortion attempts be allowed to continue unchallenged?
All my letters included the proviso re: claiming costs including, but not limited to...etc.
There is an aftermath, even if it's nuisance value. Actions bring consequences - surely pe can face what they prefer to dish out?

I'm going through with it. LBCC will be sent on Tuesday, followed by Part 36 on Thursday. Then N1 claim form 28 days after the LBCC. Particulars are already written and ready to go.

Change it to "Bank Of England Base Rate plus 8% per annum" interest rate. (That's the statutory guidance for interest applicable to unpaid invoices, as far as I recall).
