Thankyou for the helpful replies guys. I just needed some advice on where I stand. I accept I was foolish to not fully read the seller's terms, after all, I have been buying and selling on ebay since 2004 without making mistakes like this as a buyer. However, there was a lot of interest in the car with around 70 watchers and multiple best offers in the first 8 hours, so he would have had no problem selling it. However, instead of just being mature about it, he decides to go hard way and threat court action. I have had my time wasted by buyers myself but I don't go on like that.

OP I understand your point. Some folk on eBay can be total A Holes BUT you need to understand that in terms of eBay rules, you were in the wrong here.

Car sales does seem to be the main area where sellers seem to be messed about. This could have been the third time where the seller has had to relish the car due to timewasters, so u do understand why he might be frustrated.

BUT in cases like this, you are right, a mutual cancellation is usually the best way forward for both parties.

Because you don't have a leg to stand on with cash. I always try to be as cautious as possible.

Unless a warranty is offered, this is irrelevant and suggests you intend opening a case - the exact reason the seller won't accept it - as he knows what your up to :D

Apart from the fact the buyer can then leave a neg which is totally unfair - they cant if seller opens a NPB.

Another example of Ebay policy making common sense between parties difficult.

I'm not well up on car sales via Paypal but I suspect that that isn't the case and Paypal protection is not the same as for purchases of most other items.
Your best protection in buying a second hand car is paying by credit card. Getting it checked out by a mechanic before parting with cash is another option.

  • Just put yourself in the sellers shoes. When you to come to sell your car, and decide to sell it on ebay, rather than autotrader or something. Then wouldnt you want to be be paid cash on collection. you shouldnt want someone come to collect the car and you hand over the key and then having the money taken away from you because the buyer on ebay said to paypal and ebay that they did not come to collect the car/ did not buy the car.
