BPA and POPLA rules allow the registered keeper to appeal a PCN.     Please note that the following practices are also considered to be a breach of the code of practice of the organisations you claim to be members of:
    1. asking the registered keeper to enter into further correspondence to obtain a POPLA code
    2. failing to supply a POPLA code within the rejection correspondence
    3. appearing to indicate that the issue of a POPLA code is conditional on the details of the driver of the vehicle being supplied.

      For your information, I intend to forward a copy of your letter to the BPA, the DVLA and the AOS as evidence of your non compliance with codes of practice. I also intend to inform my local MP and the OFT.
      I suggest that you seek to mitigate your non compliance by supplying a POPLA code by return of post or cancelling the PCN.

      Any help would be appreciated especially if I need to reference any legal stuff etc

    I wouldn't mention the OFT in your letter because they no longer exist, this reference will just show them that you are not in touch with regulation changes and show you are an easy mark.
    Their duties have been spread over a number of old and new organisations.
    I would guess that would now come under the responsibility of Trading Standards, or, as it is a matter of contract possibly the Competition and Markets Authority (CMA).
    I would be interested to know who is the relevant body, and if you are willing to do the leg work please let us know.

    Is there an AOS (Approved Operator Scheme) to report to? Isn't the AOS run by BPA Ltd?

    Dear Sir
    I am writing to register a complaint against VCS who claim to be members of your organization and as such are supposed to abide by your agreed code of practice.
    As the registered keeper of the vehicle noted above I attempted to implement the appeal procedure in accord with VCS's terms and conditions.
    I have enclosed a copy of their letter to me which clearly demonstrates their flagrant abuse of your code of practice .

    For your information I have listed their abuse of your code of practice below

    Asking a registered keeper to enter into further correspondence to obtain a POPLA code

    Failing to supply a correct and valid POPLA code within the rejection correspondence

    Appearing to indicate that the issue of a POPLA code is conditional on the details of the driver of the vehicle being supplied

    Given VCS' s obvious abuse of your code of practice and flagrant abuse of the terms and conditions of their membership of the BPA I would like to know exactly what disciplinary procedures will be implemented to prevent such unlawful and unsanctioned behavior being continued.
    Such behavior demonstrates VCS' s total disregard for your organization and begs the question as to whether they should be allowed to remain as members.
    If the BPA fail to act on the information provided, which from evidence in the public domain is clearly not as isolated incident, then the credibility of the BPA and its existence as an independent body must be questioned.

    I intend to forward a copy of the above letter to my local MP and the DVLA.

    I await your reply with interest.

    Yep - the only thing I would add is what you want the BPA to do about your case - such as that you require them to ensure VCS either cancel the PCN or send you a valid POPLA code within 14 days. And you want the MP to be aware of this sharp practice, so soon after the POFA 2012 was supposed to improve this 'industry'.
