Balcony on top of my bay window

The OP could put up a screen on his side? Or buy voile/net curtains for the bedroom?
Having bought in full knowledge, it seems late to complain?0 -
There has been no planning permission or building regs done but I have been told the Council will not take any action as more than 4 years have passed, who is responsible if the roof collapses?0
-
Did you REALLY ask them to move the balcony ????
I really can't see why you didn't get all this sorted out pre-exchange. It's very likely the "good price" was down to the overlooked bedroom.I Would Rather Climb A Mountain Than Crawl Into A Hole
MSE Florida wedding .....no problem0 -
The good price was because of the house being neglected for the last 50 years I am doing my best to restore it to as near original as possible. I only asked for a screen to be installed two foot away from my bedroom window and the handrail to be shortened so that it is not fixed to my bay window, I thought this was a reasonable request.0

I'm in no way legally trained, but surely you could remove the handrail yourself from your bay window? It is on your land- so could it not be treated in the same way as overhanging branches, estate agents signs etc. i.e. removed, but not damaged, and returned to the owners. If they put it back up surely they are trespassing on your porch.
It is a bit weird that you bought it without questioning this. And my guess is that they think they are in the right as they bought theirs having been told it's always been this way and has been for too long to be challenged.0 -
Lol i love the pic of your neighbour sunbathing on the balcony.
Tbh i would do as previously suggested and put some shrubs in tubs along the boundary. That way they cant look in at you so easily. I would also prob cover the side window, to block them out even more
I take it the flying freehold only goes as far as their wall is painted, so in front of your window, the balcony is yours?0 -
The problem is if I remove the handrail the balcony becomes unsafe would I be liable if someone is injured?

You are right as to what they think but I am trying to find out how I stand legally can they obtain what was part of my house by squatting? if they can who owns the porch roof? is my bay window wall now a party wall? do they own the outside of my bay window wall near the balcony?0 -
Tell them you've decided to have your porch removed. Then get the builders in.0

fle72 they are claiming all the balcony is theirs so I can not put any tubs on it. The flying freehold inside does not extend to my bay window wall it stops 2 ft short of that but they have painted white right up to my bay window.0
