The difference is that this phone is designed to have the cover taken off as part of normal operation (as opposed to, say an iPhone, which is sold as a sealed unit).

Therefore, if doing that is prone to damaging the phone, then it is a fault in design, which is covered under warranty.

    Didn't know that. Thnanks

You are deluded. Or simply don't listen.

Any phone can be damaged by a user during normal operation: dropped, cracked when carrying in a pocket, water damaged when using under rain - and trying to get it repaired under warranty/SoGA will be a waste of time, efforts and money.
Three will say that the screen was accidentally broken by the user, and the chances are slim that any judge disagree with them if the case goes to a court.
Throwing good money after bad springs to mind.

And iPhones aren't different from other phones in terms of warranty/SoGA.
The difference here is that I have not dropped the phone, I was not careless with it I was merely taking the back off to put the battery in to use the phone. Something that has to be done with any phone. Something I have done countless times with my old phone with no problem at all. To be honest I don't even know if the touchscreen was working to begin with as I didn't get a chance to try it out. If doing this cracks the screen then IMHO there is a definite fault with the design of the phone.

Your problem however is going to be proving this was the case.

This references the above - 3's defence is essentially going to be that the Lumia 520 is widely considered to be an excellent budget device which is very durable, and is also by far and away the most popular windows phone device ever sold, by miles and miles.
Nokia are literally selling tens and tens of millions of the things, any "design defect" that you're claiming would by now be very widely known about - Therefore arguing with 3 that the phone is defectively designed is unlikely to get you anywhere because this is demonstrably not true.
Assuming you genuinely were careful with popping the back off its more likely you have a unit which has an individual manufacturing fault of some kind. Pursuing this angle with 3 or Nokia may get you further.

I hear what you are saying but this has been widely reported on the internet, whether they have sold thousands or not. At the end of the day, 3 are the retailer so they are responsible for replacing the unit, not me.

A quick bit of Googling doesn't really turn up any of these "wide reports" - Results for shattered/cracked lumia 520's shows plenty of people dropping their phones (not the phone's problem, Nokia phones are generally considered pretty durable but they're not magic) and a grand total of 1 thread on Nokia's discussion forum where a few people cracked their screens while trying to insert the battery, and it would seem at least a few of those people tried to do so by prising the screen away from the phone rather than pulling the back cover off, which is their own stupidity.

The point is that it's not that simple, because you are going to them with a problem which to all appearances is a problem with you having an accident, not a fault with the phone.
In that scenario it's you that needs to either convince 3 that the phone is faulty in itself or hope you get a staff member on a particularly good day, otherwise they'll just say "you broke it, your problem".

I have a Sony Ericsson Xperia which I have dropped a few times and it is still in perfect condition. If Nokia phones crack at the merest hint of pressure by the user then they are flimsy and badly designed.

As for convincing 3, as I said I dont even know if the touchscreen was working to begin with as it cracked before I even had a chance to switch it on.

It now appears that 3 dont really want anything to do with this as they are deleting questions from their Support section without answering them. terrible customer service. Quite prepared to take my money every month but shrug it off when they dont want to take responsibility (or even help). Complaint has been fired off but I dont suppose that department will be very helpful either. Does anyone know the email address for the big chief of 3 as I may want to contact them?

Thank you. 3 have now agreed to credit me with £35. Would not supply a new handset. Not quite the result I wanted but the best I could get I guess.
