    Your a maniac, im in bearsden and paying 850 (now advertised at 875), for a 2 bedroom lodge, a four bedroom villa for the same money, aye right are you on a different year or another planet. :rotfl:

    i was earning more, took a more expensive house, im now earning less and looking for somewhere cheaper, makes sense and its really obvious and i dont need you to tell me such obvious thing, but it will make you feel better having another dig, what a cyber bully.

    Its bearsden, the posh area, its the going rate im afraid. There is not many other affordable houses in the area, tough finding one so my daughter can stay at the school.

    Bearsden is a lovely place, i came from stevenston in ayrshire, its a dump, so it was an amazing difference. There are cheaper houses, just not many available to rent,

    The estate agent did send something by recorded delivery, i cant remember what, i cant find the letter but it may have been this. Ill need to ask.

    As for the bills, i did not know this when i took out the tenancy but this is part of the agreement, due to the council not sorting out my benefit claim and me having no money to pay council tax, it turns out i was not due any benefit so i must owe about £900, i was going to ask them if i could pay this up over the coming year. The estate agent has told me i have to show them the agreement to show this before they will give me my deposit.

    The agency are talking !!!!!!!!. Your council tax is between you and East Dunbartonshire council and has diddly squat to do with the LA. When you move out just claim your deposit from the DPS.

    This was my thoughts too, as im new to this, what condition need to be met for SDS to release my deposit. Do they check with the estate agent if everything is in order?

    edit- after reading the documents on claiming back the deposit, the landlord can only claim any outstanding costs ie rent arrears or repairs. They cant stop it because i have not paid my council tax bill in full?

    You claim your deposit back and the agency either agrees or they can dispute giving you the full deposit back due to damages or something but not CT and utilities because those are your bills, not the property's bills.

    Any damages they want to claim for they have to prove you caused.
  • Assuming that the landlord has only issued a notice to quit and hasn't applied to the courts for possession... if you stay in the property beyond the end of your current fixed term you will automatically create a periodic tenancy that requires you to provide at least a tenancy period of notice, therefore by remaining in the property for even one day will lumber you with a legal liability for 2 months of rent and you'd probably end up with a CCJ if you refused to pay. You should avoid this at all costs, stay in a hotel if you have to, it's only for 1 day!

    Thanks pixie, you gave me a lot of good information, i can now get back to the agents and tell them if they dont issue my deposit ill start the claim myself. Its quite galling they are forcing tenants to do this. A lot of people will be like me and dont know any better, they have nothing to gain from this so heaven knows why a supposed respectable estate agents would demand this.

    Oh dear this does not sound so good. Somewhere to stay is not the problem, its somewhere to keep my furniture and stuff, a few van loads, I dont have anywhere to put it and i can afford to pay someone to uplift it and store it for a few days.

    Actually, it looks like it might be even worse under Scottish law.
    Fixed term tenancies

    Your tenancy may have been set for a fixed amount of time, for example six months or a year. Some tenancies automatically repeat themselves at the end of the fixed term. For example, if your tenancy is for six months, at the end of that six months, it will automatically start again for another fixed term of six months, this is called tacit relocation.
