Some of these replies are astonishing. 12 months ago, I checked in here on someone else's behalf, and the advise was to ignore these things. I've already prepared our response, but the attitudes in here really are appalling.

If the legal situation has changed so much that MSE has been advising *against* ignoring these scammers for 12 months, why has *that* particular piece of information not been more widely disseminated?

Ahem...I advised against ignoring these fake PCNs and encouraged/pushed people to try POPLA as early as November/December 2012. I also changed my signature to the one below early in 2013 and put it in bright red so people reading old threads might see it on my old posts (all old posts show the new sig of course).

And when we got snowed under with queries because the advice had changed in 2013, I wrote the NEWBIES thread which gives you your 'get out of jail free card' right now, this weekend, to simply rewind the clock so you too (well the driver, but you could pen it yourself copied from our templates) can appeal and win at POPLA.

Not sure what else you are looking for? You want the POPLA golden ticket? It is in the grasp of the driver NOW, if only you write in response to that LBCCC and give the name and address. PCN arrives, they appeal, hey presto, come POPLA stage, they win (thanks to our advice).

If you don't do this then the keeper will likely be defending this in court. I know which advice I would choose. Pass the gauntlet to the driver, even if YOU win it for them. EASY.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

And what precisely did you find 'appalling' in my attitude when I posted my reply to your query - see below.

HO87 said that just one single PPC has issued over 13,000 court cases in the past year. Guess which one. Yours I'm afraid.

The PE modus op, generally, is not windscreen ticket-based, rather the use of ANPR cameras sited at the entrance/exit of car parks timing ins and outs.

Advice changed because of the court case scenario and, importantly, the motorist now has an avenue to independent dispute resolution (which is binding on the PPC, but not the motorist) in the shape of POPLA, and we found out how to win at POPLA, and have done so every time for the past year.

The NEWBIES thread will cover most of what you need to do, so regardless of when advice changed, you do need to get on with this now.

If you are able to enlighten me please do so. If you can't, good luck with your impending court case, I'm afraid I'm not going to be around.

This is, exactly, my 3,000th post on the forum in around 15 months. If you read my signature (at the bottom of this post) you will see the constant advice I've given with every reply - this has been my signature for most of my time on the forum. So this has been stated almost 200 times every month since January 2013.

So, just how, precisely, would you anticipate that a small group of volunteers, giving freely of their time to help people like you with THEIR/YOUR problem, should have 'disseminated *that* piece of advice more widely'?

Full page adverts in the national press, or maybe some 30 seconds adverts during prime time TV? Come on, let us know.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Umkomass: When I retuned to these boards to check on this company, I checked to see when the last post advised people to ignore these PCNs, because I knew it wasn't "18 months ago" as widely claimed here. It was about March 2013, sometime *after* I'd last posted. I might add that at that stage, not one person advised that ignoring was no longer the way to go. Not one.

Ignoring was then (and still is now) a valid option (e.g. with UKPC) - perhaps not recommended, but still valid. Just not with Parking Eye ... and they started becoming very litigious, when? ...... around April 2013. So at the time of your previous incursion to this forum, ignore was still an option even with PE.

So what's your hissy fit response this time?

so the fact that coupon-mad in one of here replies in December 2012 said that people could appeal to POPLA went unnoticed then ?

NOTHING HAS CHANGED EXCEPT THE PPCS CAN NOW CHASE THE REGISTERED KEEPER FOR THEIR UNENFORCEABLE PIECE OF TRASH, RATHER THAN JUST CHASE THE DRIVER. YOU CAN STILL IGNORE A FAKE PCN. OR IF IN ENGLAND & WALES, YOU CAN USE POPLA (THERE'S A STICKY ABOUT THIS).

or this one from 10 november 2012 https://forums.moneysavingexpert.com/discussion/comment/57143257#Comment_57143257
    - if your 'ticket' is from a non-banned by the DVLA!! AOS member in England/Wales, there are 2 choices:

    a) IGNORE IT, as ever, playing snap with the threatograms that match our sticky thread 'PPC letter chains' (near the top of this parking forum), :)

    or

    b) Appeal it with help from here in how to word it, and insist on a referral to the POPLA appeals service if it's not cancelled. Costs the PPC £32 plus, costs you nothing, it's not binding on you but it is binding on the PPC. If you do not win your appeal then revert to ignore mode.

    This option is for those who want to fight back, cost the PPC money and test the POPLA system whilst also getting their PPC's tactics scrutinised;

or the fact that you personally discussed this "NEW LAW" in jan 2013 and claimed you would read up on it back then and advise others accordingly ?

Redx has encapsulated perfectly in the above post the way that advice moved with the introduction of PoFA, gradually mutating from 'ignore' to 'appeal' as the forum learned more about how to handle and defeat PPC PCNs via POPLA in the new PoFA era.

There wasn't a switch-over date, whether it was 18, 15 or 12 months ago cannot be precisely time-stamped. Why you need to split hairs over a more precise dating escapes me. The one thing is clear, the 'new' advice has been around long enough that anyone getting a PCN today couldn't miss 'appeal' advice.

Why would anyone take old 'ignore' advice when current 'appeal' advice is now so ubiquitous?

a further forum search shows the change happened about mid february 2013 https://forums.moneysavingexpert.com/discussion/4458671 post #14 and definitely by march 2013

the link above shows 21 feb 2013 where coupon mad clearly states the case for appealing at popla, so approximately 4 to 6 weeks after this OP was on the forum stating they would read all the relevant info on the "new law"

the coupon-mad advice (and as schoolrunmum on ppp was this)
Your choices are to ignore it or (if this was in England or Wales only) to appeal, then insist on a POPLA appeal, where you can then ignore it if you don't win the appeal. Explained here by pepipoo forum:

    http://forums.pepipoo.com/index.php?showtopic=46975

and here's a thread about POPLA:

    http://forums.moneysavingexpert.com/....php?t=4263959

and a thread discussing a successful appeal to POPLA:

    http://forums.moneysavingexpert.com/....php?t=4447137

so about 14 MONTHS AGO was the correct answer ;)

(although coupon-mad did mention it previously in november and december 2012 as an alternative to the long standing IGNORE procedures)
  • RedX. Did you even red through the 3rd thread you quoted? I did.... no change, no advising anything other than "ignore"...

Would we reply to a Nigerian e-mail scam? No.... therefore...

good luck, all. You can either waste precious time writing appeals, or just do the obvious. G'night.

so you are right and everyone else is wrong ? yeah right

suggest a name change to foo1ishperson because its clear to me you discussed it it jan 2013 and decided you preferred the old ignore method, so you then ignored this parking forum for a further 15 months as well ! during which advice changed a lot in view of the changes made

your initial question was about when the advice changed, clearly it was around feb 2013 but was already being advocated in nov/dec 2012 prior to that , due to POFA 2012 in OCT 2012 coming in

take the blinkers off , when the walls are caving in around you , stop digging :D
