PCN from private firm whilst parked on main road

I recently parked on a double yellow line on the street about 50yards from a private car park. It is run by Britannia and when i came back to my car after 5 minutes i found a man writing a ticket but it was not actually on my car. Firstly can be issue in the ticket if i am not in the car park and secondly the ticket was not on the car so can i appeal this as well?

  • Asssuming this is for a Parking Contravention Notice and not a genuine penalty charge notice run by a ppc for a council, then just ignore them. If its their private road leading to the car park then its just as easy to ignore as any other. If they have tried their luck and ticketed on the council road its even less likely they will go any further, if they do try it on then you could appeal and take them to popla and cost them £27 +vat it will then be chucked out with a bloody nose.

    You can safely ignore these chancers
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

  • The thing that seems very odd is that Britannia Parking who issued the notice say on the charge that they may have taken a digital image of your vehicle. There is a camera on the side of the building who would have seen that i was parked on a double yellow but it was not in their car park so i do feel they have not got a leg to stand on.
    Their escalation process appears to be to get my vehicle details form the DVLA after 28 days - can they do this?

    Yes they can, but as long as halfway says if they are mot working on behalf of the council you can ignore.

    You will just get a few letters and that's it.

    Britannia are one of the tammer ones
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    if they are ticketing on the public highway and they shouldnt be they could be in trouble.

    They mean they give their staff a cheap digital camera to take loads of photos.
    Though watching these jokers as I do these days they tend to do it after the ticket is placed on the car so they get that photographed too.

    Does the ticket say "PENALTY CHARGE NOTICE"

    Absolutely this before you ignore anything, we need an answer, look at who payment to and where the appeal goes also
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    If they have used the CCTV on the building to record your parking and you want to be really annoying to them have a look at http://www.guardian.co.uk/commentisfree/libertycentral/2010/aug/31/householders-cctv-public-highway-film

    In particular if the Data Protection Act applies, the CCTV business operator will be required to do a number of things:

    • Register as a data controller with the Information Commissioner's Office.

    • Put up signs notifying people that CCTV is in use and who operates it.

    • Give any individual who requests it copies of footage of them (for a charge of up to £10).

    • Ensure that any footage stored is kept for no longer than necessary for the purposes for which it is obtained.

    • Ensure that footage is not disclosed to anyone else without the consent of the individuals shown in it unless it is for a reason permitted under the DPA, such as the prevention or detection of crime. :j

    The information commissioner has issued a code of practice for CCTV operators.
