Super news, now they can be spanked there to add to their defeats at POPLA as reported in the Lead Adjudicator's Annual Report:

Of 54 appeals submitted to POPLA in 2013-14, DE lost 31 - a 57% failure rate, meaning that at least half of their tickets were incorrectly issued and were UNENFORCEABLE! If you extrapolate this across all their tickets .......!

But, there are many worse on the list, which further confirms the magnitude of the scandal that all of this is!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • DE did as it was bid and issued further POPLA codes-all appeals won on grounds: 1) not genuine offer to park therefore not a claim for a contractual fee but a claim for damages; 2) charge not a GPEOL.

Thanks to all for the support and I'll check in where I can to assist others when able.

This was a great outcome! Such a shame that firm is still there suing staff & students, as we both know.

@ fedupwithitall - Any chance of a copy of that assessment? Like C-M I am assisting others with DE snapping at their heals.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Can't stand DE so it's no trouble to help their victims at Staff University (which should be ashamed of treating staff and students like this and letting an agent sue people aggressively). And allowing a business model which lets people park any old how, obstructing disabled bays and across fire escapes - oh yes, it's all OK for a fee. What on earth is the Uni thinking and does the local Fire Service know that's what is allowed?
