I would have though that, were they to use the card details collected from the OP in respect of the hire of the vehicle to pay a third party debt they would be in breach of any contract with the OP and in breach of the Data Protection Act.

This is my opinion though...would like to hear what others have to say.

Chances are the contract has something in place regarding fines, speeding issues, accidents etc.

Except these are not fines or council parking tickets, they're bills for fresh air so shouldn't be paid by the hire/ lease company. The hire/lease company just need to let the parking company know who was the driver and then the driver can sort out the invoices with help from MSE.

I'm sure it does; nevertheless I would be very shocked if it were possible for them to effectively 'forward' debit or credit card details to a third party and 'authorise' payment.

    This thread is really funny,

What the hell were you expecting parking in an Asda car park for 10 day, you are the reason others have trouble parking.

They wont though. They will pay the fine, as car owners, and charge the OP for this.

Asda in Wolverhampton had this problem, is right next door to the uni so ask the students would park there rather than on the designated paid car park.

Asda went through phases of ticketing the lot of them, but this was in the days where you could ignore the tickets.
Kind of agree with asda in this one though, it's customer parking and I'm sure you could have found some road parking somewhere.
  • This is more complex than the "It's just an invoice" argument. It's not the op who gets this invoice it's the car hire company. This is obviously going to take time to look at (even if the invoice has no weight) which causes a wage cost. So telling the op to do nothing is very poor advice.

I'm also lacking sympathy with the op anyway for thinking the could park in a Supermarket where saying it is blatant about the parking restrictions is an understatement and thinking it would all be ok!

Go to the Parking forum linked earlier and search that forum for BVRLA (the trade association for lease/hire car companies). They issued guidance late last year to remind their members that parking charge notices are NOT fines, and that they should discharge their obligations under the Protection of Freedoms Act 2012 by advising the parking company of who was the hirer/usual keeper.

If the lease/hire company is like almost every other one, their T&Cs won't allow for paying parking charge notices (invoices) ... they only allow for Fines and Penalties. Therefore any such payments made would be on their own heads and the hirer would have no liability for them - indeed they could charge them back as unauthorised transactions if the lease/hire charged such payments to the hirer's card.
  • Yeah, yeah.. I lack sympathy for myself, buddy. I just expected to get a normal ticket. The car park is always virtually empty so I didn't cause a problem for anyone.

    That probably was the problem.
There is a good chance that as the car park was fairly empty, the parking attendant (or whoever checks it out) may well have noticed your car being there day after day, especially if you were parking in the same spot every time.
