    as mentioned previously, you remove all traces of naming the driver and anything about RK too, so yes is the answer you were looking for, you make it sound correct from the drivers point of view , and send it

    I take it your letter has been signed off by the driver now. She'll win but it has to be in her name from now on and at POPLA stage, even if you are writing it.

    Yes the letter went this morning, with proof of posting and signed under my wife's name. So now I guess we just wait for rejection letter to come through.

    Hi Again all

    Received the rejection later today (14 May) dated 9th May. They claim the PCN was issued legally and correctly according to BPAAOS. They consider the amount on the PCN as a reasonable charge for liquidated damages due to breach of parking contract. They state signage is displayed in compliance with all relevant laws and regulations and they state that the fact that I was seemingly unaware of of this is not considered a mitigating circumstance for appeal. (The initial sign is on the sharp curve coming off the access roundabout, so easy to miss).

    They offer to accept the current charge for a further 14 days from correspondence date, after which the full amount is due.

    They then issue a POPLA code and state:
    POPLA will only consider cases on grounds that the parking charge exceeded the appropriate amount, that the vehicle was not improperly parked or it had been stolen, or that otherwise not liable for the parking charge.

    Finally the letter states that if the appeal does not relate to the above criteria or is rejected by POPLA for any reason, I may be requested to pay the charge at the full amount and will no longer qualify for the reduced rate.


    Is this all standard? Sorry if this post is a bit long and whats best to do next?

    Yes it's standard blurb from them, there are plenty of popla appeals on here, have a look on the newbies thread for how to win at popla, it's pretty straight forward. Once you have the wording place it up here so we can review it and ensure its a winner
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    They are trying to throw you off appealing to POPLA, don't fall for their game.
    Follow the advice on here from the regulars and you will win and easy victory and cost them money.

    Thanks Fisherjim, these guys stop at nothing I guess, I just loved the cheap inkjet printed rejection letter. Following Storma's previous advice, I have spent the hour or so reading the POPLA section on the newbies section and other linked posts. I checked my Code an I have over 20 days to appeal so I am going to spend weekend putting together my case and getting a picture or two of their terrible signage...
