I got a car on finance in January 2014 which was sold to me wrongly. As I found out 2 months after driving the car that it had no valid MOT and that it failed the MOT the day before they allowed me to drive it away. I paid for an MOT & Service to be done and when I collected it I was told it had been done and was fine! (But they said they had misplaced the not certificate and they would post it me, after 8 weeks of being fobbed off everytime I called in to the dealer or called them I received a call saying that they couldn't print the mot and to resolve it they would re MOT the car and that would sort the problem. This set alarm bells of with me and I had just received my V5C document that day so I checked online and saw that the car had been MOT'D but failed so I have been driving around for 2 months with no mot!

From day 2 of having the vehicle it developed a whining / grinding noise from the rear of the car and I took it back to the dealer who tried to fix it on a number of occasions and failed every time! Since then I have had a number of issues on the car which have all been reported to the dealer!

I have now reported this to my finance and they are dealing with it but I have a unroadworthy car and can't use it due to issues with it.

Is there anything I can do more than I have done already?

    Get another opinion from a reputable garage but you must explain to them you recently bought the car and they must not do any work on it.

    Then take their findings to the place you bought the car from and see what they say.

    The MOT could have been a simple mixup. These things happen.

    Whining noise on the rear when driving or even when stopped? Only when moving = wheelbearing or brakes. With the engine running fuel pump. Parked with the engine off also fuel tank breather.

    What other issues?

    Its not unroadworthy just because you have a whine. Its not unroadworthy without the MOT either.
    But saying that the MOT only testes certain things and doesnt mean its safe to use. Silly eh.

    Thanks for the reply, I have had an engineers report done on the car and had the car checked by vauxhall and 2 local garages which have told me that the brakes need replaced car needs four new tyres and the emissions on the car are faulty! (Which the dealer are disagreeing that this needs done despite getting 3 opinions)

    Would I have any grounds to hand the vehicle back?

    Sorry the other issues are the heating in the car is cold doesn't warm up! And various lights coming on the dash I.e parking sensors & electrics

    How did you not pick up on at lease SOME of these issues on the test drive?

    Worn tyres - easy to spot
    Warning lights on dash - unmissable
    Heater not working - didn't you test it?

    Or have all these come to light since you bought it?

    Yes I did test these, and these were working and the issue with the noise is only detectable at high speed over 60 mph and I did not yet drive the car at a high speed until after I purchased it!

    And the tyre seamed fine to me first time buyer I was clueless the tread was fine the issue is they have all been driven on flats not the tread!

    i do not think you were missold a car on finance as you did sign the agreement after inspecting it did you not.

    you should rephrase and state the car you purchased from dealer has faults and no MOT after the agreeing the term of the finance.

    you may want state the car, year and hopefully you will directed to the right options

    How many miles have you driven in the last 3 months? Tyres do not last forever.

    Have them mot it now, even better. 3 months extra mot. But have it done as soon as possible.
