Ebay, if it's in the picture is it part of auction?

Hi, I wondered if someone could give me a bit of advice.... I recently bought a handbag on Ebay which I could never have afforded new and in the picture it was shown sat on its dustbag. When bag arrived there was no dustbag so I contacted seller who said she hadn't said dustbag was included. Because it was in the picture…

I bought a handbag in TKMaxx last year (£30, PU bag) and that came with a dustbag.

And my brand-new leather bag from the M&S outlet store also came with a dustbag....not that I shall be needing it, I'm using my lovely new bag everyday!
