Hello everyone.

Firstly great advice in Coupon Mad and Ukomaas posts on NEWBIES PRIVATE PARKING TICKETS. thank you...

I was taking my 87yr old Grandad shopping in The Range, he gets out of breath and has to rest and we went to the cafe inside too.

10 Days later a penalty charge notice comes through the door asking for £60 rising to £100 after 14 days, as we were half hour over the allowed time.

Im shocked and my Grandad feels really bad. I took step one in the guide and headed down to the range to speak to the manager, he wouldnt do anything about it as my grandad paid cash and can barely remember last week let alone where he put his receipts.
I asked for the Managing Directors name which he gave but he refused to give me any contact details for him or anyone else who was in a more senior position than himself...is it worth hunting details for a much more senior member of management to contact?
He gave me the customer service email address, which just sounded a pointless fob off.

I am going to copy and paste the template letter as advised in the next stage for my fist appeal to PARKING EYE, then if that is not accepted draft up a letter to POPLA. I read in the guide not to use any excuses in this 2nd letter so I shouldnt mention my Grandad shopping or anything..?

Is there a chance I may have to pay this fine down the line.? If so will they then say "as the 14 days has passed the fee is now £100"


Sorry to bombard questions, but the advice here is awesome and you all seem to know your stuff.

These Merchants of Misery should not be allowed to operate so i will fight this as best I can.

    Don't worry about paying anything, if you follow the advice on these forums you won't pay a penny. The first thing to do is to send the appeal to ParkingEye, use the template contained within the first post of the Newbies sticky thread. Feel free to post it up here when you're ready to post it.

    ParkingEye will reject this but will give you a POPLA appeal code. This is where you will win.

    In relation to the M.D. I cannot find any contact details beyond the generic customer services e-mail. Perhaps a letter addressed to him would make its way through. But in the meantime you need to start the appeal ball rolling.

    Follow the advice, forget circumstances and mitigation, appeal technically.

    The place for mitigation and stories of shock are the Range's Facebook page.
    Local papers, the daily mail, local radio.
    You get the jest.

    Whilst there is general advice to complain to the retailer, The Range does not have a good track record in this regard (a fair indication of the 'value' it places on its customers). So, I'd say you've done as much as you can on that front - time now to concentrate on putting this to bed via the appeals' route.

    Initial appeal to PE using the template in the NEWBIES sticky (well done on reading through that first - oh that they were all like you), then move to POPLA appeal once you get the (inevitable) PE rejection.

    Don't forget to send that initial appeal off with a free Certificate of Posting from your Post Office (don't use 'Signed For').

    The circumstances aren't really worth raising even in your 1st letter - as already advised and the template letter is all you need to to send

    But if your grandfather has medical conditions that would qualiify him you may be able to make a point about the Equality Act and making reasonable adjustments for persons with protected characteristics.

    If so you could add an extra point along the lines

    "1/ Failure to provide reasonable adjustment under the Equality Act 2010
    The driver was accompanying an elderly relative who suffers from medical conditions that qualify as protected characteristics under the Equality Act 2010.

    It's illegal for a service-provider to implement a blanket policy, like an arbitrary time limit, if it has a detrimental effect or causes disadvantage to a person with protected characteristics. A parking charge cannot kick in at the same time - X hours - for a disabled (or elderly, or maternity protected) person as it does for a non-Equality Act protected person.

    By attempting to levy this charge you are failing to provide reasonable adjustment for a person with a protected characteristic therefore you are contravening the Equality Act 2010."

    I was going to email the 1st Appeal to get it moving quicker, but just realised the P.E appeal box is too small to copy and paste the template into.

    Can I state "please see attached letter" in the appeal box? Then attach the letter? Might sound a stupid question, but dont want them trying some technicality rubbish.

    If not ill have to try and borrow a pals printer and go with Umkomaa's good suggestion of posting with free certificate of posting.

    Collies, he does have a disabled badge so we can park nearer for him, so maybe that could help my case.

  • Hi again! anybody know roughly how long it takes to hear back from the appeals...?

    I emailed P. EYE on the 31st of March and have not had an email back yet.

    Prior to the Range incident I received my first parking ticket from a council which I have already appealed this was about 10 days ago as I didnt know about this place yet :cry: for parking my motorbike near a bicycle rack on the pavement with two other motorbikes next to it and only I was ticketed .

    I got a reference number from the council one...but with Parking [STRIKE]Die[/STRIKE] Eye, I just got a message confirming its been submitted, which... given their rep concerns me....

    Did you receive an e-mail from PE acknowledging receipt of the appeal?

    They can take a while to deal with an appeal (28 days from receipt is what is said on their website). You'll probably receive the standard appeal rejection letter in the next 7-10 days.

    I would advise if you have time to post them an appeal with a free proof of postage, and they have 35 days to respond to you
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
