Good Morning.
Sorry if this comes across as a dumb question.
if my wife does not meet the criteria for the new PIP and is moved on to JSA, does that mean her incapacity benefit stops as well, or does PIP only replace DLA?.

PEP is the replacement benefit for DLA only.
all those on incapacity benefit will be trabsferred to ESA.
if the ESA 'medical' is not passed, the only option would be to claim JSA ( or appeal the ESA decision)
a claim for JSA would only be successful if the claimant is actively seeking work

many thanks for the reply. she has had a letter to attend for an atos medical on April 8th, i guess this is to get her transferred to esa then?0

if she has already applied for PIP, then the ATOD medical could be either for that or ESA.
the appointment letter should tell you which benefit the medical is for.
if it iis ESA, i would strongly advise you to look at the descriptors, to see where her problems fit.
if you work more than 24 hours a week and she is placed in the work related activity group, then her benefit will run out 265 days from the date of the transfer to ESA.
the qualifying vriteria for PIP and ESA have some very major differences

she hasnt applied for pip. letter just arrived out of the blue. she is on IB and DLA lower rate at the moment. i work full time.

OP... you need to search for the ESA descriptors.
she needs to score a minimum of 15 points to be placed in the WRAG, or to meet one of the support group descriptors to be placed in the support group.
an ESA medical isnt a medical as such. it is much more of a box ticking exercise.
if she cant show where she fits in and which boxes she ticks, then she will fail the medical.
as said, have a look at the descriptors and gather as much supporting evidence as possible to show that she meets the necessary descriptors

just to say that the threads about ESA that appear on forum such as this are the horror stories.
many people, including myself, sail through the process with no issues at all.
the best advice i can give is to be prepared.
look at the criteria and see where your wife's condition slots in, and supply as much supporting evidence as possible

Hi.
After the excellent advice by nannytone I have checked my wifes letter from atos.
it doesn't mention any specific benefit.
It just says she needs to attend regarding her "claim for benefit". So, is it likely it is to get her moved from IB on to ESA?.
Also, if I could ask advice from other forum members could you fill me in on the following. Apologies for long post:
My wife originally went on to IB due to chronic arthritis. But, some years ago she contracted Guillan Barre Syndrome, which nearly killed her.
if I have googled correctly, guillan barre is on a list of conditions that has to be assessed by a doctor, not just a hcp.
can anyone confirm this, and if correct, should we mention it at the outset of the assessment?0
