    Clause 12.5 states that items should be returned in perfect condition, unused and in the original packaging. True that it doesn't actually state for hygiene reasons, but every other website I've known excludes duvets, duvets covers, mattress protectors, pillow cases etc for that very reason, so I can't see this one being any different.

    Regardless, the item isn't unused, and so therefore can't be accepted back.

    So gullible people who do not know their rights can be swindled, helped by people who have no clue what they are talking about giving well meaning but wrong advice on internet forums.

    Seriously though, is something that has been out of the packaging and ON the bed not classed as used? Because in my books, that is used, and I personally wouldn't want it after someone else had had it on their bed. I'm genuinely interested to know.

    Admittedly, I shouldn't have said that they definetly weren't included in the DSR, but I seriously thought they were. I seriously thought I'd read something about it.

    Amara have repled that Regulation10 is overruled by their Terms and Conditions!!!!!!!
    As a gesture of Goodwill they will not deduct the £10 from the refund.

    I don't think trying something to see if it fits constitutes as being used. Imagine all the clothes tried on in shops every day and not purchased, the retailer doesn't have to then show them as used or second hand items.

    No actually I am not trolling, definetly not, that's not my style. I do believe what people have told me on here (George Michael and thumb remote answered perfectly adequately), I shouldn't have answered unless I knew for sure, and for that I'm sorry. I just asked you a genuine question in reply to your post because I was genuinely was interested to know.

    Sorry for derailing your thread OP. I genuinely thought that if you had a contract with the retailer then things like that weren't covered, I've been proved wrong, I guess you learn something new every day, and hope you get it sorted. :)

    Amara should be reported to Trading Standards ... but only after you have your full refund. ;)
