Ebay promoting the selling of fake goods.

I recently purchased a replacement iphone lead from an ebay seller, who advertised the item to be 100% genuine apple product.
When I received the item it was very apparent that the lead was a fake, which was verified by Apple. I had to return the item to the seller before ebay would issue a refund.
Because I received a fake product I left the appropriate negative feedback for the seller just stating that the item was a fake.
To my amazement Ebay removed the feedback at the seller's request. Ebay explained to me that when a refund is issued the seller is within his/her right to have any feedback removed.
This is so wrong, there is no way of warning any potential buyers that the seller is selling fake goods. Ebay are only promoting the selling of fake goods if this is their policy for removing feedback from fake goods.

You should not return fake goods. If you tell ebay it's fake they should ask for proof which you had. No point in getting proof if you're just going to send it back as not described. When you give the proof to ebay they should refund you and tell you to destroy the product. The seller is unlikely to admit it's fake so obviously they're going to ask for the item to be returned.0

They removed it because you stated it was a 'fake'...this is not allowed. It is only your word against the sellers that it is a fake, if you had taken it to Apple and they had confirmed it was fake in writing and sent your evidence to Ebay they would of dealt with it as such.0

This was not the reason.. according to Ebay.
Here is a copy of the Ebay email why the negative feedback was removed:
I have gone through the case and found that this was closed on your seller's favour as they were able to issue you a full refund. I sincerely understand that you are worried about the feedback you left but was removed. I'd be happy to explain things to you.
From May 2013, if a seller wins a case, any Feedback left by the buyer who raised the case will be removed automatically and excluded from their seller performance evaluation. This includes Feedback scores, comments and detailed seller ratings.
Feedback will be removed when a case is found in a seller’s favour and they were able to resolve their customer's concern. We want to ensure that our marketplace is safe and fair for both buyers and sellers and this is one of a number of initiatives we have launched.0 -
So if you buy anything fake dont ask for a refund?
I presume the seller pays ebay a lot of money in fees.
Its amazing how they will bend over backwards for some sellers, Yet smaller ones are banished without a second thought and no chance of appeal.
Some time back i reported several sellers for illegal banned items. All the smaller sellers had the listings pulled. A couple were no longer registered users.
But the couple of larger sellers still had the items listed.Censorship Reigns Supreme in Troll City...0 -

If you buy something fake then to get a refund state the item is fake and get a refund based on that rather than item not as described. It may not be as described if listed as genuine and actually fake but if an item is not as described ebay tell you to return it for a refund and any seller selling fakes is more than likely to say the same whereas it's different if you tell ebay it's fake.
It hasn't got anything to do with fees. As far as ebay as concerned with this the item was SNAD and the seller resolved the issue and followed ebay rules meaning feedback could be removed. The buyer didn't tell ebay it was fake.
Sometimes ebay don't act on things they should but that's nothing to do with this situation.0 -

I did report the item to be fake to Ebay. I was informed that I had to return the item to the seller before a refund could be made.
I carried out this and by doing this the seller was therefore awarded the case and was entitled to have any feedback removed. It's just so wrong!0 -

How did you report it? Did you escalate the case to ebay and inform them then? Did you use ebay chat? Phone them? Did you refuse to send it back and show ebay the proof it was fake?0 -

I just went through the ebay resolution centre, there was an option to report counterfeit goods which I selected. I requested a full refund and ebay informed me that I had to return the goods to the seller before a refund could be issued. I returned the goods, left the feedback and then Ebay informed me that the seller was awarded the case because he had made a refund and is entitled to have feedback removed.
Ebay never asked me for proof that the item was fake. I have now found out that the listing photo shows the item to be a fake product (which at the time I was unaware of)0 -
