Parking ticket in a private spot

Hi - I'm sure everyone on here is fed up of newbie questions, but I have one!

Me and my friend went to park in an arena car park tonight, which is usually £3 all night. It was shut for some reason so we pulled up to a nearby street which had a sign saying "£3 all day, after 6pm £1ph".

We got there at 7pm, just as the show was due to start. We were in a rush to get to the show and I genuinely read it as "after 6pm £1". Stupid I know and I feel like a mug. My friend rushed out to put the money in the machine and I slapped the ticket on the dash before we rushed the kids into the arena. We returned at 9:05pm, to find a PCN on the windscreen timed at 20:38, saying that a valid ticket had not been displayed.

we looked at the sign again and noticed the "ph" added on the £1 on the sign. The ticket is for £100, or £60 if paid within 14 days.

As I understand from reading the sticky, I have to wait for a notice to keeper with 56 days, then send them the template letter and it should all go away. Is this right? I have seen that there is a further POPLA process, but not sure what this involves.

the company is CPS Midlands so I'm guessing this falls under a private company.

any advice would be gratefully received, thank you.

You have got it bang on provided that:
1) You are the registered keeper of the vehicle
2) This was in England or Wales

POPLA is an appeal route that you can use once you have appealed to CPS Midlands and they have rejected your appeal.

Yep you've read it correctly, wait until the Notice to Keeper to arrive before you do anything, unless you are not the registered keeper?? So please confirm that

thank you, I really appreciate the swift responses. The car is mine and I'm on the log book etc, so am the registered keeper.

I'm kicking myself over the sign and can see this being a long drawn out crapfest, which at 7 months pregnant I could really do without!

There is no reason that you can't do most of the work now in terms of editing the templates, and then just insert the relevant dates/reference numbers once you get them.

thanks, I'm going to put the 56 days on the calendar. What happens if they don't send the NTK in 56 days?

Unfortunately nothing happens. Technically the law sets out that if they miss the deadline then the keeper cannot be held liable. POPLA do not tend to enforce this though. The courts should, but if you follow the advice on this forum it won't get that far.

thanks, I guess I'll just have to wait and see what happens. still annoyed though, I'm wondering if the sign is deliberately worded that way to catch people out.

If you think the sign was misleading get a photo of it to include in your POPLA appeal.
