thanks, ...... I'm wondering if the sign is deliberately worded that way to catch people out.

    What a shocking suggestion, mary;)

Well done for your intelligent reading and research so far. Just keep following the advice. Ensure that any photo replicates the angle and distance of that night. How dark was it? Was the sign near lighting? [These could be add-ons to the tried and true appeal points.]

Hi - I've finally recieved a Notice to Keeper (although it says notice to owner?) telling me that I have seven days to pay £100 or the charges will go up. But the seven days is crossed out and someone has written "28" next to it.

Am I right in thinking that they had 28 days to send me a Notice to Driver, then a further 28 days to send me a Notice to Keeper?

This is more than six months after the alleged contravention, so do I just ignore this Notice to Keeper/Owner or should I send off the template letter?

    TIA

I've got a question (sorry to hijack the thread; ) what happens if you don't pay the fine? ;) Can they take you to court?

    So don't, please.

Answers to your ? are in the Newbies Thread - and you'll know not to use the f-word either.

    It isn't one.

By all means start your own Thread, but I'd say you'll receive similar answers.

Marywooyeah, send off the template in the newbie thread. However as a new point 1) (bump the others down) say something alone the lines of:

I deny any charge as there is no registered keeper liability since the NTK arrived xx days after the alleged offence. Under POFA 12 the NTK should arrive no more than 56 days after the alleged offence.
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

put a complaint in to the dvla and bpa over this, they have no reasonable cause to get your details 6 months after the event, ask the dvla when your details were released as well. There can be no RK liability as they are so far out of date with this, scan your letter into both.

Just use Coupon's sticky thread for appeal wording to the company, add at point 4 that there is no keeper liability and to take a running jump with their fake ticket

thank you - this is very helpful.

And Stroma thank you too - I never would have realised I could complain to the DVLA so will give them a ring in the morning.

thanks so much for your help - this forum is invaluable.

No don't ring, scan your letter in and use the complaint process in post 6 of Coupon's thread, its much more effective as a phone call to them.

We would love to see a photo of that 'Notice to Owner' (a misleading term as well, worthy of complaint as 'NTO' is a Council term). Please can we see that altered pile of rubbish, both sides, all wording?! Also you must complain to the DVLA about releasing details so late as I think there's a limit. And I found another point for DVLA complaint:

''we are bound at all times by the DVLA’s code of conduct for the release and processing of data and The Administration of Justice Act 1978.''

Well I am sorry but there is NO 'DVLA code of conduct' so that needs removing from the website urgently - it's wholly misleading. Tell the DVLA & give them the link.

Going by their website I guess they are ex clampers!

    http://www.cpsmidlandsltd.co.uk/

In general, ex clampers are as thick as !!!!!! IMHO and should get back to being door minders or whatever else they are able to do in life with half a brain cell. This bunch are even too lazy to put their own signs up or issue tickets:

    http://www.cpsmidlandsltd.co.uk/services.html

''our legal department pursue the motorist for the charge. ''

Yeah sure they have legally qualified people in their team! Hilarious!

And here's one to quote at POPLA stage:

''only genuine offenders and not customers etc are penalised should a parking charge be issued in error.''

Ooops their Legal Dept must have missed that sentence in the exhaustive proof-reading process!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Alain Hutton and Jemma Duber of Basford, Nottingham. A right pair of morons. Nothing to worry about.

Check with the local council that this really is a private street. Not unheard for a parking company to put up signs and charge people where they have no right to, particularly if there's an event in the vicinity.
