    The sign is a pathetic attempt at claiming a £100 penalty is a contractual charge. A contractual agreement is not made merely by putting the words 'contractual agreement' on a sign. The sign states very clearly that parking is for permit holders only in their allocated space with a permit on view in the windscreen i.e. if you aren't a permit holder you are not permitted to park. You cannot enter into a contract to do something that is not permitted.

    Seen that sign before and I have a POPLA appeal I wrote for someone else which is specifically about that sign wording - I will send it to you by pm. That sign isn't standard wording as it doesn't allege a breach - and it could fool a POPLA assessor which is why you need a strong POPLA appeal.

  • Just had a thought, I noticed on the popla website that you can submit additional evidence as a .pdf such as witness statements. Would it be worth asking the property manager who is in charge of the land here to put that he believes the ticket should be cancelled in writing. I could then submit this as additional evidence?

    It certainly can't hurt to do so.

    Have you already sent in your POPLA appeal? If yes, was it based on a PM from Coupon-mad?
  • Unfortunately I'd already sent it based on the above feedback before the PM. However I have uploaded a PDF with a reworked version of the PM from the angle of "If UKCPS claim their signage does not allege a breach then please consider that..."

    That was the best I could think of...
  • It gets better, I now have another NTK letter for a different parking charge notice also for parking without permit, there was never a notice left on the car for this one though. Guess I'll have to go through the whole process again anyway.

    Sounds good - as long as POPLA see the words then it will do fine, as they do allow extra submissions - and best of luck with the next one too!

    Appealing to POPLA will always cost the PPC money. So it is always worth doing even if you are in the position of being the actual leasee rather than a tenant.
    In the case of the OP, the more PCNs he gets, the more POPLA appeals he can submit & the more £32's the PPC will have to part with.
    As he now has (thanks to C.M.) a full-blooded appeal letter, all the hard work has been done and any future appeals just need a careful editing of the original letter to change the date, PCN no. and POPLA appeal code.
